"Era para mí una necesidad reunir en un trabajo orgánico los distintos capítulos de la teoría del delito, que había ido tratando en recensiones y artículos dispersos. Quiero suponer que en una época en la que el material didáctico existente resulta ya anticuado, ante las innovaciones incisivas de la legislación, y en la que la situación económica de los estudiantes no es propicia para la adquisición de gruesos libros de texto, no ha de ser mal recibido un trabajo cuyo principal objetivo es delinear claramente el esqueleto ideológico de lo que sería la clase funda-mental en un curso de derecho penal. A lo que he dado un valor decisivo es al correcto ordenamiento sistemático de las distintas materias. Como consecuencia de ver las cosas desde ese punto de vista, la teoría del dolo es suplantada por la teoría de la culpabilidad, el error sobre las circunstancias de hecho por el error sobre el “estar prohibido” (Verbotensein), el estado de necesidad justificante por el meramente disculpante.
