Over the past few decades, a growing number of studies have highlighted the importance of the ‘School of Salamanca’ for the emergence of colonial normative regimes and the formation of a language of normativity on a global scale. According to this influential account, American and Asian actors usually appear as passive recipients of normative knowledge produced in Europe. This book proposes a different perspective and shows, through a knowledge historical approach and several case studies, that the School of Salamanca has to be considered both an epistemic community and a community of practice that cannot be fixed to any individual place. Instead, the School of Salamanca encompassed a variety of different sites and actors throughout the world and thus represents a case of global knowledge production. The Matter of Empire examines the philosophical principles invoked by apologists of the Spanish empire that laid the foundations for the material exploitation of the Andean region between 1520 and 1640. Centered on Potosi, Bolivia, Orlando Bentancor's original study ties the colonizers' attempts to justify the abuses wrought upon the environment and the indigenous population to their larger ideology concerning mining, science, and the empire's rightful place in the global sphere. Bentancor points to the underlying principles of Scholasticism, particularly in the work off Thomas Aquinas, as the basis of the instrumentalist conception of matter and enslavement, despite the inherent contradictions to moral principles. Bentancor grounds this metaphysical framework in a close reading of sixteenth-century debates on Spanish sovereignty in the Americas and treatises on natural history and mining by theologians, humanists, missionaries, mine owners, jurists, and colonial officials. To Bentancor, their presuppositions were a major turning point for colonial expansion and paved the way to global mercantilism.

Thomas Aquinas’ Summa theologiae is one of the classics in the history of theology and philosophy. Beyond its influence in the Middle Ages, its importance is also borne out by the fact that it became the subject of commentary. During the sixteenth century it was gradually adopted as the official text for the teaching of scholastic theology in most European Catholic universities. As a result, university professors throughout Europe and the colonial Americas started lecturing and producing commentaries on the Summa and using it as a starting point for many theological and philosophical discussions. Some of the works of major authors such as Vitoria, Soto, Molina, Suárez and Arriaga are nothing more than commentaries on the Summa. This book is the first scholarly endeavour to investigate this commentary tradition. As it examines late scholasticism against its institutional backdrop and contains studies of manuscripts and texts unpublished, it will remain an authoritative source for the research of late scholasticism.

Their concepts, deeply entangled with ideas of theology, state formation, and human nature, form the bedrock of todays theoretical discourses on international law. This volume engages with models of early international legal thought from Machiavelli to Hegel before international law in the modern sense became an academic discipline of its own. The interplay of system and order serves as a leitmotiv throughout the book, helping to link historical models to contemporary discourse. Part I of the book covers a diverse collection of thinkers in order to scrutinize and contextualize their respective models of the international realm in light of general legal and political philosophy. Part II maps the historical development of international legal thought more generally by distilling common themes and ideas, such as the relationship between universality and particularity, the role of the state, the influence of power and economic interests on the law, and the contingencies of time, space and technical opportunities. Resorting to natural law is one way of conveying the philosophical conviction that moral norms are not merely conventional rules. Accordingly, the notion of natural law has a clear metaphysical dimension, since it involves the recognition that human beings do not conceive themselves as sheer products of society and history. And yet, if natural law is to be considered the fundamental law of practical reason, it must show also some intrinsic relationship to history and positive law. The essays in this book examine this tension between the metaphysical and the practical and how the philosophical elaboration of natural law presents this notion as a "limiting-concept", between metaphysics and ethics, between the mutable and the immutable; between is and ought, and, in connection with the latter, even the tension between politics and eschatology as a double horizon of ethics. This book, contributed to by scholars from Europe and America, is a major contribution to the renewed interest in natural law.
