Nessun periodo storico ha conosciuto tante organizzazioni internazionali come quello che stiamo vivendo, eppure il sistema della governance globale sembra vacillare. Lo scopo per il quale tali organismi sono nati, a cominciare dall’Onu, era quello di gestire in modo pacifico e vantaggioso le tensioni tra gli Stati, dando vita a un sistema multilaterale in grado di costruire, nel tempo, un ordine giuridico internazionale da tutti riconosciuto e applicato. Oggi questo paradigma viene pesantemente messo in discussione. Il mito della globalizzazione, in crisi già dal 2008, è contraddetto nel suo teorema fondamentale, quello del primato della geoeconomia sulla geopolitica, della massimizzazione dei commerci co¬me presupposto per la minimizzazione dei conflitti. Siamo davanti a un ritorno della politica internazionale come pura politica di potenza. Una politica che non chiede di essere legittimata in quanto agente di attuazione e restaurazione di un ordine internazionale violato, ma come instaurazione di un ordine nuovo. A oggi non è possibile dire se gli anni che verranno saranno quelli di un ritorno del multilateralismo, vale a dire di un sistema di relazioni internazionali basato sul diritto, oppure di una definitiva affermazione del multipolarismo, fondato sul principio di potenza, con la conseguente creazione di sfere di influenza. Certamente le crisi che stiamo vivendo impongono di ragionare in modo nuovo: ci dirigiamo verso una terra incognita e insicura. Ecco allora l’importanza di avere a disposizione elementi di analisi e orientamento che consentano di tracciare un percorso di riforme possibili per assicurare prosperità, pace e stabilità al mondo del XXI secolo.

The book explains why law — international, regional, domestic, formal or soft — should restrain global actors in the same way that judicial oversight is applied to domestic administrative agencies. It outlines the emerging web of global norms designed to protect the rights and interests of all affected individuals, to enable public deliberation, and to promote the legitimacy of the global bodies. Global Governance from Regional Perspectives argues that the academic debate on global governance has neglected the combination of power with value constellations/culture.
