En la presente obra se analizan, en su primera parte, las diferentes modalidades de negocio jurídico patrimonial en cuyo proceso de formación concurre una previa intervención judicial de autorización, o una posterior intervención judicial o notarial de aprobación. En la segunda parte se analizan las principales cuestiones controvertidas que plantea la autorización judicial a los progenitores prevista en el artículo 166 del Código Civil, y la aprobación judicial o notarial de la partición con pago en metálico de la legítima prevista en el artículo 843 del mismo texto. En ambos casos se analizan las soluciones propuestas desde la doctrina y la jurisprudencia, revisando algunas de ellas y proponiendo otras nuevas.José Javier Lanchas Sánchez (Madrid, 1965) ejerce como abogado especialista en Derecho Civil desde 1994, aunando una dilatada experiencia en la práctica jurídica ante Juzgados y Tribunales con una sólida formación académica. Es Doctor en Derecho por la UAM, y Diploma de Estudios Avanzados en Derecho Procesal por la UCM. Compatibiliza su ejercicio profesional con la docencia en diversas Universidades, habiendo sido Profesor del Máster de Acceso a la Abogacía de la UAM, Profesor Honorario de la misma Universidad, y Profesor del Máster de Práctica Jurídica de la UCLM.

La capacidad de la persona es uno de los temas más interesantes del Derecho de la persona y, además, hunde sus raíces en numerosos ámbitos de otras ramas del Ordenamiento Jurídico, como, por ejemplo, los referidos a la capacidad para contraer matrimonio o la capacidad para hacer testamento. Los procesos de incapacitación de la persona, tal como nuestro Derecho los concibe, están estructurados de forma que se convierten en auténticos sistemas de protección del sujeto que no ostenta, con plenitud, la capacidad intelectiva, o cognoscitiva, y la capacidad volitiva, es decir, la voluntad. A esta función, precisamente, están llamados los organismos tutelares.
