La nueva teoría del constitucionalismo contemporáneo se manifestó, principalmente, en el proceso de constitucionalización del derecho, el cual implica que la Constitución impregna con sus valores y contenidos todos los ámbitos del derecho y de la vida social. Aquello, desde luego, supone un importante cambio en la comprensión del objeto y la interpretación del derecho, así como también en la relación entre este y la moral. Lo expuesto ha producido un verdadero cambio en los conceptos de Constitución, constitucionalismo e interpretación constitucional, lo cual, a su vez, ha redimensionado y potenciado la labor de jueces y juezas constitucionales. No obstante, ello no les otorga un poder sin control a estos juzgadores: su accionar tiene límites, como los que el autor nos explica en esta obra.

En la presente Tesis se estudian las Reformas Constitucionales y su repercusión sobre las Suprema Corte de Justicia de la Nación en México 1994, dentro de un marco de análisis comparado de la Justicia Constitucional en Europa y en Estados Unidos de América. Tanto la forma en que han sido introducidos los mecanismos de la Acción de Inconstitucionalidad como ejercicio práctico por parte de la Suprema Corte han resultado deficientes tanto técnicamente como desde el punto de vista de la normalización democrática. Se proponen algunos mecanismos que permitan superar la obsesión por el legislador negativo que ha caracterizado a la justicia constitucional en Europa como la obsesión contramayoritaria propia de los Estados Unidos en América mediante la adopción de mecanismos de mayor participación y diálogo y mediante un perfecionamiento de la regulación técnica de la Justicia Constitucional en México.
