The Interpretation of International Law by Domestic Courts assesses the growing role of domestic courts in the interpretation of international law. It asks whether and if so to what extent domestic courts make use of the international rules of interpretation set forth in the Vienna Convention on the Law of Treaties. Given the expectation that rules of international law are to have a uniform interpretation and application throughout the world, the practice of domestic courts is considerably more diverse. The contributions to this book analyse three key questions: first, whether international law requires a coherent interpretive approach by domestic courts. Second, whether a common or convergent methodological outlook can be found in domestic court practice. Third, whether a common interpretive approach is desirable from a normative perspective. The book identfies a considerable tension between international law's ambition for universal and uniform application and a plurality of different approaches. This tension between unity and diversity is analysed by a group of leading international lawyers from a wide range of geographical, disciplinary and methodological approaches. Drawing on domestic practice of number of jurisdictions including, among others, Colombia, France, Japan, India, Israel, Mexico, South Africa, the United Kingdom and the United States, the book puts the interpretative practice of domestic courts in a wider context. Its chapters offer doctrinal, practical as well as theoretical perspectives on a central question for international law.

Con este trabajo pretendemos demostrar que los jueces de protección son pieza clave en la configuración de una red judicial de protección a varios niveles que, además de potenciar la efectividad de la garantía ofrecida a los individuos, coadyuva en la configuración de un escenario jurídico global con características constitucionales. Esto nos permitirá corroborar que la constitucionalización del derecho internacional es un proceso que, en efecto, hoy tiene lugar y que su desarrollo ayudaría a enfrentar la creciente complejidad del escenario jurídico global, así como a determinar su futuro. De nuestra hipótesis de trabajo se desprenden varios interrogantes, como: ¿qué entendemos por red judicial?, ¿cuáles son sus características?, ¿cuáles son las herramientas con las que cuentan los jueces internacionales de protección para construir la red judicial?, ¿cuál es el contexto que alimenta ese proceso?, ¿cuáles son sus alcances? Pero aún más, partiendo de la idea de que dicha red coadyuva en el proceso de constitucionalización del derecho internacional, debemos preguntarnos cuál es el vínculo entre la idea de una red judicial –y sus aportes– y el constitucionalismo internacional. Para responder a estas preguntas y, con ello, desarrollar nuestra hipótesis usaremos como punto de referencia el trabajo del juez interamericano de derechos humanos y su relación con los jueces constitucionales latinoamericanos.

OMAR VÁZQUEZ SÁNCHEZ es Doctor en Derecho con mención internacional por la Universidad Pompeu Fabra de Barcelona (España). Su tesis doctoral, titulada Teorías neoconstitucionalistas, fue evaluada por Luigi Ferrajoli, Susanna Pozzolo y Juan Ruiz Manero, quienes decidieron otorgarle la máxima calificación "Sobresaliente Cum Laude". En 2006 cursó el Máster Universitario Iberoamericano de Estudios Jurídicos, y en 2011 el Máster Oficial en Derecho de la Globalización y de la Integración Social, ambos en la Facultad de Derecho de la Universidad de Navarra (España). Es licenciado en Derecho por la Universidad Autónoma de Tlaxcala (México). Ha realizado estancias de investigación en la Universidad de Cambridge (Inglaterra) con el profesor Matthew Kramer; en la Universidad McMaster (Canadá), bajo la supervisión del profesor Wil Waluchow; así como en el Instituto Internacional de Sociología Jurídica de Oñati (España). Es profesor e investigador en la Universidad Autónoma de Tlaxcala.
