La kafala, il principale strumento di diritto islamico di tutela dei minori, è uno di quegli istituti che ha destato, e ancora oggi desta, consistenti difficoltà. In effetti, quando assume una dimensione “internazionale”, se non viene regolamentato in maniera puntuale, può prestarsi, proprio come accadeva fino a qualche anno fa per le adozioni internazionali, a degli abusi in danno dei fanciulli. L’entrata in vigore della Convenzione de L’Aja del 1996 «sulla competenza, la legge applicabile, il riconoscimento, l’esecuzione e la cooperazione in materia di responsabilità genitoriale e di misure di protezione dei minori», ha gettato le basi per una migliore cooperazione e per un più facile superamento delle principali difficoltà.
