Inspirée par la Philosophie des Lumières, la liberté d'opinion et d'expression a pris corps dans la Déclaration française de 1789, en ses articles X et XI. Elle doit sa juridicité aux constitutions et conventions internationales qui, au cours des dernières décennies, ont concrétisé la protection des droits fondamentaux ; en instituant l'Union européenne, le Traité de Maastricht du 7 février 1992 a confirmé, à cet égard, les garanties stipulées en 1950 par la Convention de sauvegarde des droits de l'homme et des libertés fondamentales. Dans les rapports entre particuliers qui concernent notamment le droit du travail, la faculté de se forger des convictions, de les manifester et d'y conformer sa vie -loin de s'effacer au seuil de l'entreprise- peut s'y exercer dans la mesure où elle ne nuit pas aux obligations contractuelles du salarié. Aux confins du droit public et du droit privé, l'attrait d'un tel sujet tient à ce que les convictions du travailleur mettent en jeu une philosophie des droits de l'homme : car, absolue dans son principe, la liberté d'opinion et d'expression figure au rang des principes généraux, que l'ordre juridique communautaire emprunte aux traditions constitutionnelles communes aux Etats membres de l'Union européenne. Mais, dans toute démocratie pluraliste dont elle constitue l'assise, la liberté d'expression s'exerce selon les limites que lui assigne l'ordre public, afin d'assurer à autrui la jouissance de ses propres prérogatives. Ainsi le choix de l'étude proposée tient autant à l'actualité de ses sources qu'à l'intérêt épistémologique des problèmes soulevés par la sauvegarde des convictions personnelles dans les rapports collectifs et individuels de travail.
