El autor, preocupado por lo que acontece con los derechos humanos, en particular con la libertad de expresión e información, se ha dado a la tarea de investigar lo que existe jurídicamente sobre ellos. Primero, en los dos sistemas de comparación: el europeo y el interamericano. Enseguida estudia la libertad en sus distintas modalidades en el marco del derecho, como el medio que la regula y permite que todos podamos gozar de ella. La libertad de expresión, nos recuerda el autor, conlleva siempre un alto grado de responsabilidad, que exige respeto a los derechos de personalidad; sus límites son el respeto al honor, la intimidad personal y familiar y a la propia imagen, derechos que si no se respetan dan lugar al derecho de rectificación (en el caso mexicano, conocido como derecho de réplica o de respuesta). El autor compara, de manera ordenada y crítica, los elementos estudiados, tanto en el caso español como en el mexicano, señalando la necesidad de actualizar la materia y de realizar adecuaciones legislativas, lo que supone para el caso mexicano una verdadera reforma.

This edition of the Inter-American Yearbook on Human Rights , like the volumes that precede it, includes information concerning the activities of the Organization of American States in the promotion & protection of human rights. It begins with the composition of the Commission & Court, including the biographies of the members, 1988 activities of each body, reproductions of resolutions & reports by the Commission & historic correspondences & decisions by the Court. Also included is an update on the status of the American Convention on Human Rights, which reports the relation of each country to that instrument, followed by resolutions adopted in 1988 by the OAS General Assembly. The year 1988 distinguished itself particularly because the Inter-American Court of Human Rights made its first decision on a contentious case, the Velásquez Rodríguez case (Honduras). This historic decision is reproduced in Part Three of this volume. Another important 1988 development in the Inter-American system was the Protocol of San Salvador, or Additional Protocol to the American Convention on Human Rights for Economic, Social & Cultural Rights, reproduced in Part Four. Al término de la Guerra, Louk Hulsman emprendió sus estudios de derecho, pero lo cierto es que en pocos años se graduó y pasó a prestar servicios en el Ministerio de Guerra y luego en el de Justicia. Entre 1963 y 1986 fue catedrático de derecho penal y criminología en la Universidad de Róterdam. Diseñó la política de drogas holandesa y fue el impulsor del famoso Report on Decriminalization del Consejo de la Unión Europea (Estrasburgo, 1980). Desempeñó diferentes cargos en las directivas de la Asociación Internacional de Derecho Penal, en la de Defensa Social y en la de Criminología, fundando además ICOPA (International Conference on Penal Abolition). Su actividad internacional, la constante participación en congresos, jornadas, seminarios y otros eventos académicos, era una muestra de su enorme capacidad de diálogo. Su vida se apagó súbitamente, en su apacible y alucinante casa de Dordrecht, el 28 de enero de 2009. Veinte días antes Hulsman había sido nominado para el Premio Nobel de la Paz, en razón de su condición de padre de la política holandesa de tolerancia en materia de drogas. Pocos meses después, la Sociedad Holandesa de Criminología lo distinguió póstumamente con el premio Bonger (Willen Adriaan Bongerprijs).
