L’opera analizza il problema della “logica nel diritto”, con le numerose e gravi imprecisioni delle leggi. Queste ultime inducono a ritenere che esse siano basate su regole mutevoli ed ondeggianti, e non su regole logiche. Si è ritenuto da taluno che la logica delle leggi non sia identica alla logica matematica e contenga regole logiche diverse, che richiedono un’attività di correzione da parte dell’interprete e di colui che deve applicarle, ed anche nel triplice controllo giurisdizionale. Quest’impressione non è errata ma le leggi, nonostante le imprecisioni e le sovrapposizioni, hanno una loro logica interna, e sotto lo strato frammentario e confuso delle norme vi sono delle radici che tengono assieme il tutto, e consentono il funzionamento del meccanismo del sillogismo giuridico. Vi è infatti una logica “nelle” leggi, e che riguarda i loro rapporti, il loro bilanciamento, dal momento della loro redazione, a quello della loro interpretazione ed applicazione. La logica è quindi “nelle” leggi, e non vi è sempre una logica “delle” leggi. In entrambi i casi essa si basa sui princìpi di identità e di non contraddizione, e costituisce il denominatore comune di tutte le norme, le leggi e dei princìpi che confermano la presenza di regole e teoremi costanti, anche con i cambiamenti determinati dalla gerarchia normativa. Il presente saggio, dedicato allo studio di questa “logica”, considera le leggi del passato e le leggi vigenti incardinate negli attuali sistemi ed ordinamenti normativi.
