La L. 26 novembre 2021, n. 206 contiene una radicale riforma della figura del giudice e del rito per le persone, i minorenni e le famiglie, un vero e proprio cambio di paradigma all’interno del quale si colloca lo spazio riconosciuto alla Mediazione Familiare, all’interno del nuovo processo unitario radicato avanti un nuovo Tribunale, quello unico per la famiglia. Lo scopo di questo ebook è quello di porre l'attenzione verso lo spirito che la Riforma Cartabia porta con sé, assegnare un ruolo centrale ai sistemi alternativi di risoluzione delle controversie, le c.d. ADR, la mediazione civile, la negoziazione assistita e l’arbitrato e, più in generale, alla mediazione dei conflitti. Non si tratta semplicemente della volontà di incentivare la degiurisdizionalizzazione per il contenimento del numero di contenziosi e ridurre il carico ai giudici. Si tratta di agire anche su un piano differente, culturale e sociale, finalizzato al superamento di quella logica avversariale dicotomica tipica del processo per favorire una modalità compositiva dei conflitti che sfociano nelle controversie. Ecco perché la Riforma Cartabia ha valorizzato, tra le altre, la Mediazione Familiare per quelle che sono le sue specifiche finalità. In vista della prossima fase di emanazione dei decreti attuativi, l’Associazione GeA Genitori Ancóra, ha presentato al Legislatore le proprie osservazioni e gli elementi di criticità ravvisati nella Riforma, ha organizzato incontri di confronto e dialogo nella consapevolezza dell’importanza che la lettura della Riforma avvenisse attraverso tutti i protagonisti che ruotano attorno alla famiglia in crisi e in conflitto: Giudici, Avvocati, Mediatori Familiari.
