Hace ya décadas que se detecta que los tribunales/cortes supremos/as no cumplen eficientemente con su labor. En general, son víctima de una tremenda acumulación de casos que ha activado tradicionalmente restricciones formalistas a su acceso, hasta llegar a la actual selección discrecional de asuntos de los tribunales anglosajones —certiorari— y de algunos otros del mundo que han copiado ese modelo. Además, existen presiones políticas e ideológicas que, para bien o para mal, marcan su quehacer decisivamente. Todo ello ha conformado unos tribunales ciertamente peculiares. En realidad, no acaba de existir un consenso sobre la misión que debe desempeñar el tribunal que está en el vértice de la pirámide. Si para unos esa misión es prácticamente legislativa, otros insisten en que no debe olvidarse que a los tribunales supremos se accede a través de un recurso. A partir de ahí se ha desarrollado una pluralidad de modelos intermedios. Es por ello por lo que la doctrina ha reaccionado cuestionándose sobre cuál debe ser, en realidad, la misión de esos tribunales de la cúspide. En esta obra se reúne a varios de los autores más destacados sobre el tema a nivel mundial. Sus opiniones son claras, pero están en una constante evolución que suscita una profunda reflexión en el lector, ya que va a encontrar pareceres coincidentes y otros muy contrastantes. En todo caso, la lectura no le va a dejar indiferente, percibiendo claramente la complejidad de un tema que no puede resolverse sin conocimiento de causa. Este libro, justamente, ofrece una información bastante exhaustiva y muy novedosa para conseguir obtener dicho conocimiento de un modo condensado, sin perder la riqueza argumental que el tema encierra.

Tribunal Supremo en relación con asuntos o materias de análoga naturaleza a las que, sin embargo, el tamiz jurisdiccional de cada Sala altera su identidad, resultando de ello decisiones jurisprudenciales contradictorias, es un hecho constatable, que obstaculiza ineluctablemente la labor nomofiláctica de nuestro Alto Tribunal. Ante este panorama, nuestro ordenamiento carece de un instrumento válido y eficaz para paliar estas antinomias, pues ni la Sala Especial de Conflictos contemplada en los artículos 42 y siguientes de la LOPJ, ni el empleo masivo de disposiciones legislativas ad hoc de atribución competencial excluyente y exclusiva han podido paliar la cuestión. El objeto de estas páginas es someter a reflexión si en nuestro ordenamiento jurídico-constitucional tiene cabida la universalidad jurisdiccional para el Tribunal Supremo tal y como es concebida para órganos similares en el Derecho Comparado, como instrumento homogenizador de la doctrina casacional y, si fuese así, qué ventajas y qué obstáculos removería tal opción legislativa. Si las costuras de nuestro temo constitucional resisten la universalización material de los órdenes jurisdiccionales en el Tribunal Supremo, debe darse un paso más y sostenerse que cualquier instrumento, mecanismo o sistema jurídico que tenga por objeto la mejora, en su más amplio sentido, de la más alta instancia jurisdiccional de nuestro ordenamiento debe aplicarse desde la exigencia de un presupuesto previo de inexcusable contemplación: depurar rigurosamente el papel constitucional y jurisdiccional del Tribunal Supremo y decidir, con todas sus consecuencias, si se quiere continuar disponiendo de una institución que soporte una litigiosidad inasumible dada su naturaleza de facto de tercera instancia, o bien, se opte por redefinir al Alto Tribunal como un verdadero y genuino tribunal casacional, encargado de la función esencial que el constituyente en el artículo 123 del Texto de 1978 previo para él, que no era otra que unificar la jurisprudencia sobre la interpretación y aplicación de la Leyes como intérprete del ordenamiento jurídico y acrisolador de las posturas doctrinales que lo socavan, eludiendo el mayor peligro al que se enfrenta una Corte Suprema, en general, y el Tribunal Supremo de España, en particular, que no es otro que la expansión incontrolada del mecanismo de la casación.
