No one denies that the institution of collective bargaining between workers and employers has been a powerful tool for social dialogue. Without our history of effective collective bargaining there would be no mutual understanding, no industrial peace, no constructive cooperation between social partners. Yet there is a feeling today that this history has drawn to a close; that our post-industrial world demands something different, something our tradition of collective bargaining and collective agreements cannot give us. What information and insight can we gather to verify or challenge this feeling? This was the first major question addressed by the distinguished delegates to the twenty-seventh World Congress of Labour and Social Security Law held at Montevideo, 2'5 September 2003. The aim of the conference was to discover current problems regarding the existing structures and functions of collective bargaining in industrialized countries today'problems readily identifiable in the context of economic globalization, falling union density, the increase in atypical and knowledge-based workers, and the 'tertiarization' or declining economic importance of manufacturing-based industry. This bulletin contains some of the most important papers devoted to this major theme of the conference. It presents twenty national reports, each written by a scholar well-versed in the law and practice of collective bargaining in the country covered. Two introductory reports deal with such general issues as the varying competences of representatives under different legal systems, labor union representation within the public sector, the development of collective bargaining in EC law, the levels and structures of collective bargaining practice, and the widening gap between the relevant legal norms and real situations. The national reports were drafted on the basis of a questionnaire, which appears as an annex. This allows the reader to easily compare the solutions set forth for consideration in the various countries under review. The Actors of Collective Bargaining will be of great value for all practitioners and academics in the field of industrial relations.

La négociation collective est un élément essentiel du système des relations sociales dans les entreprises. Elle contribue à produire des normes, à déterminer les conditions de vie au travail, à organiser les relations entre les acteurs sociaux. Si l'analyse des déterminations structurelles est indispensable à la compréhension de ces processus, il est important de comprendre aussi la manière dont les acteurs locaux s'emparent, retravaillent et mettent en oeuvre les normes sociales établies, comment se créent des configurations singulières, complexes, qui vont aboutir à des situations de négociation originales et soumises à des changements permanents. Le travail de négociation, comme tout travail, nécessite un temps d'apprentissage, demande la mobilisation de ressources, fait appel à des compétences, et comporte des formes de coût pour les différents acteurs. En partant de l'analyse de l'activité des personnes qui négocient, nous montrons la complexité de ces processus dans lesquels s'enchevêtrent en fait des négociations multiples, avec des acteurs hétérogènes, qui se fondent de manière implicite sur la loyauté des comportements, et au sein desquels le conflit n'est jamais absent.

The seminar on 'Freedom of Association' was held in Reykjavik (Iceland) from 26 to 28 August 1993. It was organised by the Directorate of Human Rights of the Council of Europe in cooperation with the Ministry of Justice of Iceland, and dealt with the following four themes: freedom of association and political democracy; freedom of association and civil society; freedom of association and social democracy; freedom to form and join or not to join trade unions. Written communications were presented on the following subjects: case law of Article 11 of the European Convention on Human Rights, freedom of association and the freedom of associations, freedom of association of immigrants in Europe, freedom of association and public service and freedom of association, labour law and the needs of a democratic society. About one hundred personalities took part: representatives of governments of member States, representatives of non-governmental organisations, members of the European Commission and Court of Human Rights, professors and other interested persons from Central, Western and Eastern Europe competent in the fields covered by the themes of the Seminar. This publication contains the Proceedings of the Seminar: the official speeches made at the opening ceremony, the reports and written communications, the interventions, the final report and the list of participants. Le Séminaire sur la 'Liberté d'association' a eu lieu à Reykjavik (Islande) du 26 au 28 août 1993. Il a été organisé par la Direction des Droits de l'Homme du Conseil de l'Europe en collaboration avec le Ministère de la Justice de l'Islande. Ce volume bilingue pose la question des effets des réformes institutionnelles et organisationnelles du marché du travail sur la cohésion sociale. Dans cet ouvrage, le Conseil de l'Europe recherche la conciliation entre ce qui est inévitablement imposé par la mondialisation, c'est-à-dire la réorganisation des paramètres de la concurrence, et la cohésion sociale. La conciliation doit prendre en compte une valeur politique essentielle, la sécurité démocratique, qui se trouve d'abord dans l'emploi : le coût social et sociétal élevé de la précarité le confirme. Néanmoins, sécurité ne signifie pas rigidité et doit se traduire plutôt par la reconnaissance sociale d'un "droit à la transition" qui appelle à la coresponsabilité de tous les acteurs sociaux. La conciliation est plus qu'un devoir politique : elle est le prix de la stabilité qui assure la durabilité sociale.
