This article exalts the contribution that Francisco Chukiwamca Ayulo had in the Legal Indigenism that took place in the years 1910 and 1920 in southern Peru. Said contribution led to the rethinking of the socio-legal condition of the indigenous in order to achieve legal recognition and due protection in our national legislation. Francisco Chukiwanca not only demonstrated with his behavior and his social realization the closed defense in favor of the indigenous, but his anti-clericalism, as well as his left-wing political position, made him a respected lawyer in favor of the claims for indigenous rights, becoming a the most illustrious representative of Legal Indigenism of that time, along with personalities such as José A. Encinas. Ezequiel Urviola, Julián Palacios, Manual A. Quiroga who developed the vanguard of legal indigenism in the 20th century.

"Más de treinta años observando y participando de los procesos penales de Puerto Rico como abogado defensor y como juez han llevado al autor a concluir que el llamado castigo merecido, como principal respuesta del Estado para atender el problema de la violencia y la criminalidad en Puerto Rico, es inadecuada. La investigación realizada sobre la evolución en Occidente de la pena del castigo infligiendo dolor físico o emocional al ofensor como modelo de resolución de conflictos, demuestra cómo esta ha producido más dolor y fragmentación social que la pena impuesta para la mayoría de los conflictos criminalizados. Estos modelos de castigo están basados en la separación social del ofensor de sus comunidades originales hacia verdaderas escuelas de violencia creadas por el Estado (muchas de ellas administradas por empresas privadas con interés de lucro), comunidades marginadas y estigmatizadas por resto de la población a través de un complejo proceso de aculturación que conlleva paradójicamente, la utilización de discursos belicistas plagados de metáforas como "la guerra contra el crimen". El diseño de estas respuestas tradicionales al delito nacieron desde el poder hegemónico de los países con economías desarrolladas o economías de centro, dirigidas a atender principalmente objetivos de gobernanza política y no las necesidades de restauración de los daños que ha producido el delito en las partes directamente involucradas y sus respectivas comunidades. Sin embargo, este modelo se adoptó dado la influencia de los países dominantes en la mayoría de los países dominados de América Latina, incluyendo a Puerto Rico a pesar de las realidades socioeconómicas que nos diferencian, constituyendo este modelo hoy día para la mayoría de los delitos una verdadera barrera para el acceso a la justicia penal. Esta deficiencia estructural del sistema de justicia criminal en Puerto Rico ha permitido que las cargas emocionales que producen las necesidades no atendidas de las víctimas, el ofensor y la comunidad en general se acumulen y escalen mediantes conflictos de mayor magnitud en violencia, fragmentación y polarización social. Agotadas una y otra vez todos las propuestas, dentro del modelo existente, este libro presenta una nueva propuesta desde otro modelo que promueve la reintegración a través de la reparación de los daños causados por el delito, es decir, desde la justicia restaurativa" --
