Este libro presenta un enfoque teorico-socio-juridico de los derechos sexuales y reproductivos de las mujeres privadas de libertad o reclusas en la fase de ejecucion del proceso penal venezolano, en el contexto de los derechos humanos. Dado que, la salud sexual y reproductiva es considerada un derecho humano tutelado en la Convencion Americana sobre Derechos Humanos y la Constitucion de la Republica Bolivariana de Venezuela, quienes plantean la obligacion del Estado de promover y desarrollar politicas orientadas a elevar la calidad de vida y defensa del derecho a la salud. Asi como, en el Codigo Organico Procesal Penal y otras leyes que regulan la materia se resena la responsabilidad que tiene la actuacion del juez de ejecucion, para velar e implementar politicas penitenciarias nacionales y salvaguardar los derechos de las reclusas. Tambien, se distingue conceptualmente algunos instrumentos de derechos humanos, derechos de las reclusas y aspectos que tienen pertinencia con el derecho procesal penal venezolano, sucintamente en la fase de ejecucion del proceso penal. Finalmente se resena la importancia del tema, a traves de una experiencia investigativa-documental."

Este es el texto vigente que se encarga del procedimiento penal en Venezuela. Tiene como finalidad restablecer el orden social que fuera desequilibrado por algún delito; la acción penal es pública, ya que el Estado es quien administra la justicia mediante el desarrollo penal; lo que implica desde el poder de perseguir el delito hasta el hecho de ejecutar las sanciones penales que se materializan en la condena. El Código Orgánico Procesal Penal, en conjunto con la constitución, tiene como objetivo, garantizar los derechos tanto de la víctima como del imputado, preservar el equilibrio de ambas partes, y mantener la oralidad lo mayormente posible. Dicho código actualmente goza de modificaciones donde permite presumir la inocencia del imputado, titularidad de la acción penal y el principio de la participación ciudadana, así como el equilibrio de la defensa de ambas partes. Fue aprobado por el presidente Hugo Chávez Frías mediante el decreto N° 9.042 del 12 de junio de 2012 y publicado en la Gaceta Oficial Extraordinaria Nº 6.078 del 15 de junio de 2012. Esta edición es la completa que incluye los 5 libros de leyes, más el de prefacio y el final.
