La RDC a connu 3 guerres successives depuis 1998, elle compte à elle seule, dans les territoires de l'Est, plus de 5 millions de morts. Au cours de ces conflits successifs, les fillettes, les jeunes filles et les femmes ont été les plus touchées. Le nombre des victimes a été si important que les analystes ont parlé de guerre contre les femmes. Ces dernières ont été victimes de nombreuses exactions dont le viol. Le viol des femmes à l'Est de la RDC a été massif et utilisé comme une arme de guerre par des militaires des forces armées régulières congolaises et étrangères ainsi que par des groupes armés congolais et étrangers.Ces viols massifs se sont malheureusement avérés impunis dans la majorité des cas et ce malgré l'existence d'un cadre juridique national. En effet, l'auteur démontre combien les lois de répression des violences sexuelles et particulièrement du viol connaissent de nombreuses difficultés pour leur application, difficultés dues au dysfonctionnement de la justice congolaise caractérisée par une insuffisance notoire en juridictions, en personnel judiciaire qualifié, en logistique et en infrastructures pénitentiaires.

In the 1990s, the promise of justice for atrocity crimes was associated with the revival of international criminal tribunals (ICTs). More recently, however, there has been a renewed emphasis on domestic accountability for international crimes across the globe. In identifying a 'complementarity turn', a paradigm shift toward domestic accountability in the field of international criminal justice, this book investigates how the shadow of international criminal tribunals influences the treatment of serious crimes at the national level. Drawing on research and interviews in Rwanda, the Democratic Republic of Congo, and Sierra Leone, this book develops a tripartite framework to analyse how states and tribunals work with, despite, or against one another in the fight against impunity. While international prosecutors and judges use the principle of complementarity to foster cooperation and decrease tension with government actors, Patryk I. Labuda argues that too much deference by ICTs toward states reduces the likelihood of accountability and may enable national elites to consolidate authoritarian power. By interrogating how international accountability stakeholders relate to their domestic counterparts, International Criminal Tribunals and Domestic Accountability advocates improvements to ICTs' institutional design and more dynamic interactions with states to strengthen the enforcement of international criminal law.

The role that gender plays in determining the experience of those caught up in armed conflict has long been overlooked. Moreover, the extent to which gender influences the international legal regime designed to address the humanitarian problems arising from armed conflict has similarly been ignored. In the early 1990s, prompted by extensive media coverage of the rape of women during the conflict in Bosnia Herzegovina, the international community was forced to critically examine the capacity of international law to respond to such crimes. The prevalence of sexual violence, is, however, merely one aspect of the distinctive impact of conflict on women. Although a range of factors influence the way individual women experience armed conflict, the endemic gender discrimination that exists in all societies is a common theme: from Cambodia, where women land-mine victims are less likely to receive treatment for their injuries than are men; to South Africa, where women widowed during the Apartheid years have become outcasts in their own society. To date, the extent to which international law addresses the myriad of ways in which women are affected by armed conflict has received little attention. This work takes the experience of women of armed conflict, matches it with existing provisions of international law, and investigates reasons for the silence of the latter in relation to these events for women. It is the first broad-based critique of international humanitarian law from a gender perspective. The contribution of the United Nations, through its focus on human rights, to improving the protection of women in armed conflict is also considered. The authors underscore the need for new approaches to the issue of women and armed conflict, and canvass a range of options for moving forward.
