La presente obra tiene su origen en las ponencias, comunicaciones y debates planteados en un foro de referencia internacional tan prestigioso como el II Congreso Euroamericano de Protección Jurídica de los Consumidores, que tuvo lugar en la Universidad Autónoma de Santo Domingo, Primada de América (República Dominicana). Las relaciones entre el Derecho y la Economía constituyeron una de las principales preocupaciones manifestadas a lo largo de las sesiones programadas. Especialmente se insistió -desde una perspectiva metodológica- en la imbricación entre una y otra ciencia como elemento a considerar a corto plazo en el análisis de la realidad jurídica para que el Derecho esté en condiciones de cumplir su “función traslacional”. La idea básica es que la ciencia jurídica debe proponerse -de manera irrenunciable- transformar la realidad social mejorando efectivamente la calidad de vida de las personas, fundamento último de cualquier acción de gobierno y de toda investigación científica, y para ello debe seguir muy de cerca las valiosas aportaciones provenientes de la ciencia económica. Desde esta rica perspectiva, en el libro se abordan en profundidad cuestiones como las nuevas políticas europeas de regulación y protección a los consumidores ante los servicios económicos de interés general (SEIG); las políticas empresariales de relaciones con la clientela (stakeholder) como elemento de creación de valor en la empresa (RSE) y la rentabilidad de la protección jurídica de los consumidores; las herramientas y estrategias legales desarrolladas en el panorama internacional para garantizar la seguridad de los consumidores y los principios rectores de las políticas de vigilancia en los mercados; el sistema de intercambio rápido de información sobre productos peligrosos (RAPEX) implantado en la Unión Europea; la experiencia norteamericana de la People’s Law School; la reforma del viaje combinado y del aprovechamiento por turno de bienes de uso turístico en Europa; las soluciones extrajudiciales a los conflictos de consumo (ADRs); la más reciente evolución de la industria alimentaria y su incidencia en la protección jurídica de los consumidores en torno a los paradigmas de la globalización y de la localización alimentaria; los últimos problemas planteados por la contratación electrónica con consumidores B2C (business to consumer); la configuración típica del usuario de servicios sanitarios como consumidor en un contexto de cambio profundo del modelo asistencial; los daños punitivos como técnica preventiva; la nueva regulación legal de la intermediación en préstamos y créditos concertada con consumidores; o el análisis crítico de la posibilidad y oportunidad de un Código Europeo de Consumo, entre otros temas variados -y centrales- de candente actualidad que afloran en la práctica cotidiana a los ojos de los más destacados especialistas.
