Esta monografía analiza y critica el estudio de la prueba testimonial en el ámbito español y chileno, estableciendo como premisa que el problema más importante se encuentra en que el análisis ha estado centrado en la figura del testigo, lo que ha tenido como consecuencia que el examen de dicho elemento, el sujeto, contamine el examen de la declaración que él desarrolla dentro de un juicio. Es a propósito de las problemáticas que surgen luego de revisar el estudio de este medio de prueba, que el presente trabajo propone un concepto amplio de testimonio, apoyándose en la epistemología jurídica, a partir del cual se distingan los elementos subjetivo y objetivo presentes en la prueba testimonial. Así, se establece que dichos elementos deberán examinarse de manera equilibrada, en el mismo nivel, en los momentos de conformación y valoración de la prueba. Realizada la elaboración del concepto anterior, en esta monografía no solo se plantea este innovador examen de la prueba testimonial, sino que también se presenta, al finalizar el texto, la posibilidad de que a partir de la definición de testimonio entregada,se regulen de manera común con la prueba testimonial otros medios de prueba que comparten la naturaleza jurídica de ser testimonios y que además presentan problemáticas similares a las ya planteadas.
