"El Código Penal español, bajo el nombre de realización arbitraria del propio derecho, castigaba únicamente un supuesto de desposesión, consistente en el acreedor que, con violencia o intimidación, se apodera de cosa del deudor para hacerse pago con ella y paralelamente contemplaba la eximente de ejercicio legítimo de un derecho. Combinar estas dos disposiciones y estudiar sistemáticamente el posible encaje de los hechos en los delitos de coacciones, delitos contra Administración de Justicia, delitos contra la propiedad o aplicación de la eximente o atenuante de creencia errónea de ejercer un derecho, es el objeto de investigación del presente libro. En él se estudia el caso del acreedor que se apodera de cosa del deudor para hacerse pago como supuesto desposesión, y cualquier otro caso de ejercicio de las propias razones al margen de las vías legales supliendo el ejercicio de autoridad estatal tanto cuando lesionan la Administración de Justicia como cuando restringen la libertad ajena".
