La presente obra es el resultado del trabajo y esfuerzo de un grupo de profesores colombianos que, teniendo en cuenta el importante movimiento en favor de una reforma del derecho privada en Colombia, es consciente de la necesidad de reflexionar no solamente acerca de la pertinencia o no de una tal reforma, sino también acerca del alcance y contenido de la misma. Ahora bien ¿por qué analizar el eventual interés para el derecho colombiano, de la reciente reforma francesa del derecho de los contratos y de las obligaciones? Como sabemos, el estudio del derecho francés siempre ha tenido una relevancia particular para nuestro ordenamiento júridico. Por esta razón, y debido precisamente a la actualidad de la reforma francesa, resulta fundamental contar con la visión crítica de los juristas colombianos acerca de la orientación de dicha reforma en algunos temas fundamentales relacionados tanto con la formación del contrato como con sus efectos, al igual que en otros concernientes al régimen general de las obligaciones, todo ello siguiendo el esquema original de la reforma mencionada. El análisis de estos y tantos otros temas que se estudian en el presente libro nos permitirá contar con suficientes elementos de juicio para determinar la pertinencia o no de que el legislador colombiano se inspire, en caso de prosperar una reforma de nuestro Código Civil, en la reciente reforma del derecho francés. La manera como se encuentra estructurado la obra, además del hecho de que algunos de los autores cuentan con una formación no solamente en derecho francés, sonó también em derecho italiano o alemán permite ofrecer una perspectiva de la reforma francesa del derecho de los contratos y de las obligaciones alimentada por un espíritu tan rico como crítico, lo cual resulta fundamental para no caer en la tentación de trasplantar pura y simplemente normas extranjeras a nuestro sistema júridico, con el riesgo de desconocer nuestra propia tradición jurídica.
