La colonización del vastísimo territorio que fueron las Indias occidentales supuso una compleja empresa de intereses encontrados. La explotación de sus recursos naturales exigió abundante mano de obra que los colonizadores españoles proyectaron sobre los naturales de aquellas Indias. El presente trabajo pretende reconstruir el ordenamiento jurídico que sirvió de base para la regulación de dichas relaciones de trabajo, desterrando definitivamente determinados mitos peyorativos y de leyenda negra sobre la España colonizadora. Y es que, desde que Cristóbal Colón presentara a indios taínos ante la Reina Isabel I de Castilla, ésta ordenó, exigió y legisló para sí y para sus herederos en el Trono (Juana I, Carlos I y Felipe II) para que se les consideraran personas libres y vasallos de Castilla, y que su actividad de trabajo, aunque obligatoria, estuviera regulada y asalariada, como a cualquier otro español. No obstante, la investigación demuestra que no siempre, la legislación que, procedente de la Cancillería castellana, e incluso de la emergida de las propias instituciones españolas en las Indias, fue aplicada. Que la compulsión, la exigencia y en muchas ocasiones el maltrato de los españoles para con los naturales de las Indias en la prestación del trabajo lo acercaban más a la esclavitud que al trabajo libre. A pesar de todo, los soberanos españoles no cejaron en buscar instrumentos jurídicos que, pese a la actitud de los propios españoles de no cumplir con los mandatos legislativos, los indios fueran especialmente protegidos, creando todo un ciclo heteronómico de normas que minimizaran dicha compulsión en el trabajo y éste estuviera lleno de normas garantistas, finalmente encerradas en el contrato de arrendamiento de servicios, modalidad contractual previa al actual contrato de trabajo.Miguel Ángel Chamocho Cantudo (Andújar-1969) es Catedrático de Historia del Derecho de la Universidad de Jaén, Consejero del Instituto de Estudios Giennenses, académico de la Academia Andaluza de la Historia, investigador permanente del Centro de Historia del Derecho de la Universidad de Rennes (Francia) y Director de la Cátedra Blas Infante (Convenio Fundación Blas Infante y Ayuntamiento de Andújar). Con 11 monografías publicadas y más de 60 artículos y capítulos de libro a sus espaldas, se ha especializado en los últimos años en el estudio e investigación de la regulación jurídica de la actividad de trabajo en su dimensión histórica (Introducción jurídica a la historia de las relaciones de Trabajo, en coautoría con I. Ramos), Dykinson, 2013. En esta línea de investigación se enmarca el presente trabajo de investigación objeto del premio Eduardo de Hinojosa en Ciencias Jurídicas, en su III edición de 2020.

The expulsion of the Moriscos from Spain (1609-1614) represents an important episode of ethnic, political and religious cleansing which affected about 300,000 persons.
