La responsabilità del medico come delle Strutture sanitarie è un argomento che ha contribuito, nel corso del tempo, ad alimentare un più che vivace contenzioso giudiziario. Trattasi di materia che, per i suoi protagonisti (medico, Struttura sanitaria, paziente) e per l'ampiezza delle forme che può subire la patologia della salute, ha messo in difficoltà l'uso delle forme tradizionali di tutela, quale il ricorso al contratto (tra Struttura e paziente e tra medico e paziente) o ad una più generica responsabilità per danni provocati. Ad una giurisprudenza che si è rivelata penalizzante per il ceto medico, dovuta ad una domanda sempre più crescente di cura sanitaria, dato l'allungamento della vita e ad una offerta che ha faticato a mantenere livelli di professionalità adeguata, ha risposto una strategia difensiva del ceto medico, che ha preteso di ridurre al minimo le sue prestazioni. Il legislatore è intervenuto con il noto decreto Balduzzi (2012), che ha escluso ogni causa di punibilità per colpa lieve. Successivamente la legge Bianco - Gelli (2017) ha posto più precisi paletti, elaborando linee guida che i medici sono tenuti ad osservare. La giurisprudenza è di nuovo intervenuta, sancendo che non v'è causa di punibilità ma solo per forma di lieve imperizia, ove le linee guida siano state osservate. Il titolo del libro è significativo della duplice valenza che riveste il tema "salute" non solo quale fonte di responsabilità per chi entra in contatto con essa ma anche, più genericamente, quale strumento "di responsabilizzazione" per lo stesso paziente, che ne è, in pari tempo, oggetto (del trattamento sanitario) e soggetto (partecipante ad esso). Il libro intende rappresentare, anch'esso, una guida per tutti coloro che con la salute entrano in contatto, offrendo una linea sistematica, tale da porre ordine tra i vari fattori che hanno contribuito ad alimentare un contenzioso sempre più vivace e non facilmente traducibile in linee chiare.
