Tesis Doctoral / Disertación del año 2017 en eltema Derecho - Otros sistemas jurídicos, derecho comparado, Nota: Sobresaliente, Universidad Alfonso X el Sabio, Materia: Programa de Doctorado denominado: Cuestiones Actuales de Derecho Español e Internacional, Idioma: Español, Resumen: Colombia es un Estado Social de Derecho, de corte presidencialista,con vigencia de un modelo de democracia representativa,cuyacaracterización resulta apropiada desde el contexto de la función legislativa, en términos de algunas incidencias a la que esta función se puede ver avocada como consecuencia del modelo político adoptado. Necesariamente el legislador debe reencontrarse con la correcta forma de legislar y encontrar la forma para que, en cada uno de los textos redactados, se refleje una política de Estado orientada a una finalidad concreta, que, a su vez, se debe desarrollar según los principios y valores contenidos en la parte dogmática de la Constitución. La denuncia de la escasa calidad de las leyes, así como de la confusión del ordenamiento jurídico que, acompañado de una gran proliferación de normas, hace que el cuerpo jurídico de los Estados, se vuelva inexpugnable, inconsultable. Esto, conllevará a los tribunales a una aplicación errónea o, porque no, a una falta de aplicación. Una importante representación de investigadores en temas jurídicos, ha orientado sus esfuerzos sobre los temas legislativos, así como a establecer la relación de la producción de leyes con los diferentes regímenes de gobierno, pues se considera que muchos proyectos de leyes son presentados, algunos son estudiados y pocos son los aprobados por los congresos. Así, la inquietud se genera cuando el actor social o el investigador empieza a interrogarse sobre qué tipos de leyes son las aprobadas por los congresos, cuál es la relación existente entre el ejecutivo y el legislativo y cómo incide ésta en la producción legislativa y, sobre todo, cuál es la influencia de los Primeros Mandatarios en estos trámites. El secreto de la eficiencia - efficient secret6- establecelaformaenlaquelos candidatos que se presentan a elecciones, generalmente representando a un sector disciplinado y orientado que en el momento de la elección encuentran una baraja de propuestas, expuestas por quienes compiten en el escenario político. El secreto de la eficiencia consiste en lograr gobernabilidad, legitimada a través de decisiones de gobierno que resulten acertadas y su alineación con los intereses del poder legislativo.

In any country where there is a Bill of Rights, constitutional rights reasoning is an important part of the legal process. As more and more countries adopt Human Rights legislation and accede to international human rights agreements, and as the European Union introduces its own Bill of Rights, judges struggle to implement these rights consistently and sometimes the reasoning behind them is lost. Examining the practice in other jurisdictions can be a valuable guide. Robert Alexy's classic work reconstructs the reasoning behind the jurisprudence of the German Basic Law and in doing so provides a theory of general application to all jurisdictions where judges wrestle with rights adjudication. In considering the features of constitutional rights reasoning, the author moves from the doctrine of proportionality, procedural rights and the structure and scope of constitutional rights, to general rights of liberty and equality and the problem of horizontal effect. A postscript written for the English edition considers critiques of the Theory since it first appeared in 1985, focusing in particular on the discretion left to legislatures and in an extended introduction the translator argues that the theory may be used to clarify the nature of legal reasoning in the context of rights under the British Constitution.
