Questo volume analizza la tematica riguardante gli abusi sessuali sui minori attraverso varie direttrici parallele e, prendendo le mosse dalla normativa, l’analisi viene estesa alla elaborazione dottrinale, giurisprudenziale e scientifica. Quella approfondita in questa sede è, d’altronde, una tematica eterogenea che per essere adeguatamente scandagliata non può prescindere dall’analisi degli aspetti normativi, scientifici, psicologici e medico legali. Nel primo capitolo si prendono le mosse dai contributi scientifici per approdare ad un corretto esame del minore, approfondendo i contenuti dei vari protocolli di settore e le ragioni della formazione degli stessi. Il secondo capitolo è, invece, dedicato alle problematiche che, in casi di tal fatta, involgono la attività di investigazione e di indagine. In tale ambito viene analizzata, con particolare attenzione, la questione riguardante la delicatezza e pregnanza dei primi accertamenti e delle originarie dichiarazioni del minore, in periodo antecedente alla assunzione probatoria. Con i successivi due capitoli vengono ad essere trattati i profili prettamente giuridici sottesi alla materia in esame, ovvero la acquisizione e la valutazione della testimonianza del fanciullo, traendo spunto dalla comparazione con la normativa internazionale e tenendo presenti i progetti di formulazione scientifica ed i recenti arresti giurisprudenziali. Dal punto di vista, poi, delle problematiche connesse alla prova scientifica, con particolare riferimento agli indicatori psicologici di abuso, l’analisi di una casistica di attualità tende ad agevolarne la comprensione. Infine, il lavoro si confronta con le regole del giusto processo, con particolare riferimento ai presupposti ed ai limiti di applicabilità ai casi di abuso sessuale su minori, attraverso la indicazione di correttivi de iure condito. Con uno sguardo al futuro, da ultimo, si è ritenuto utile tratteggiare lo schema di un procedimento speciale che tenga presenti e cerchi di oltrepassare i numerosi vulnera che ad oggi, indiscutibilmente, affliggono la materia trattata. Laura Valentina Mascioli È stata ricercatore di procedura penale presso la omonima Cattedra del Dipartimento Giuridico della Università di Tor Vergata in Roma ed è avvocato del libero Foro, con specifiche e plurime competenze nel settore, che hanno suggerito l’approfondimento costituito dall’opera che si pubblica, nel quadro di altri contributi scientifici maturati nella esperienza di ricercatrice.
