Il costituzionalismo è una dimensione che ha conquistato lo Stato. Quella tra Stato e costituzione è divenuta una simbiosi così potente da contagiare anche ordinamenti giuridici, come quello europeo o internazionale, che si contendono il titolo di “costituzionale”. Se questa constatazione dice molto sulla portata simbolica del termine, non rispecchia tuttavia la realtà istituzionale che vede la costituzione solidamente ancorata allo Stato. Ingredienti necessari ne sono il principio democratico, la separazione dei poteri e lo stato di diritto. Non tutte le vicende storiche che hanno portato alla maturazione di questo concetto vantano tuttavia lo stesso peso. Inghilterra, Germania e Francia svettano tra le altre e sono pertanto oggetto di questa ricerca in quanto modelli. Comparazione o storia nella ricostruzione di questa epopea? In questo libro prevale la seconda nella convinzione che l’individualità degli itinerari non possa essere adeguatamente compresa senza ripercorrerla dalle sue origini.

Neoliberalism has become a dirty word. In political discourse, it stigmatizes a political opponent as a market fundamentalist; in academia, the concept is also mainly wielded by its critics, while those who might be seen as actual neoliberals deny its very existence. Yet the term remains necessary for understanding the varieties of capitalism across space and time. Arguing that neoliberalism is widely misunderstood when reduced to a doctrine of markets and economics alone, this book shows that it has a political dimension that we can reconstruct and critique. Recognizing the heterogeneities within and between both neoliberal theory and practice, The Political Theory of Neoliberalism looks to distinguish between the two as well as to theorize their relationship. By examining the views of state, democracy, science, and politics in the work of six major figures—Eucken, Röpke, Rüstow, Hayek, Friedman, and Buchanan—it offers the first comprehensive account of the varieties of neoliberal political thought. Ordoliberal perspectives, in particular, emerge in a new light. Turning from abstract to concrete, the book also interprets recent neoliberal reforms of the European Union to offer a diagnosis of contemporary capitalism more generally. The latest economic crises hardly brought the neoliberal era to an end. Instead, as Thomas Biebricher shows, we are witnessing an authoritarian liberalism whose reign has only just begun.

Previous efforts at legal development have focused almost exclusively on state legal systems, many of which have shown little improvement over time. Recently, organizations engaged in legal development activities have begun to pay greater attention to the implications of local, informal, indigenous, religious, and village courts or tribunals, which often are more efficacious than state legal institutions, especially in rural communities. Legal pluralism is the term applied to these situations because these institutions exist alongside official state legal systems, usually in a complex or uncertain relationship. Although academics, especially legal anthropologists and sociologists, have discussed legal pluralism for decades, their work has not been consulted in the development context. Similarly, academics have failed to benefit from the insights of development practitioners. Despite nearly sixty years of European integration, neither nations nor national loyalties have withered away. On the contrary, national identity rhetoric seems on the rise, not only in politics but also in legal discourse. Lately we have seen a rise in the number of Member States invoking their national identity in an attempt to justify a derogation from a requirement imposed on them by a Treaty article or an EU legislative act, or to legitimize a particular national reading of such an EU norm. Despite this, the European Court of Justice (ECJ) has yet to develop a coherent approach to such arguments, or express a vision of the role national identity should play in EU law. Elke Cloots undertakes this task by providing a principled and coherent scheme for the adjudication of disputes involving claims based on the national identity of a Member State.
