La codificazione degli obblighi di pubblicazione via web – operata dal decreto legislativo n. 33 del 2013 – semplifica il quadro normativo, ma rappresenta una sfida impegnativa per le amministrazioni. Il “Codice” della trasparenza amministrativa introduce, infatti, molte novità – il diritto a conoscere, l’accesso civico, la qualità dei dati, il diritto al riutilizzo, un nuovo equilibrio tra diffusione e tutela dei dati personali, la pubblicità sull’uso delle risorse – destinate a produrre un impatto significativo sul modo stesso di intendere ed organizzare i flussi informativi nelle amministrazioni pubbliche. A tutti i livelli, dunque, amministrazioni ed enti pubblici devono attrezzarsi per affrontare tale sfida con la necessaria consapevolezza dei problemi e delle opportunità, indirizzandosi verso soluzioni che diano tempestiva, piena ed efficace attuazione agli oneri informativi imposti dal legislatore. Il volume si propone di fornire gli strumenti interpretativi ed applicativi utili a questi fini. I temi – approfonditi da studiosi specializzati nel campo dell’informazione, dell’organizzazione pubblica e dell’amministrazione digitale, e da qualificati operatori di settore – sono trattati in modo sistematico ed organico, tenendo conto della prassi e delle buone pratiche già maturate, ma anche delle ultime novità: - aggiornamento dei requisiti di accessibilità - nuove linee guida per la redazione del Programma triennale per la trasparenza e l’integrità - requisiti di trasparenza nel settore degli appalti pubblici. This book examines the issue of free access to information as part of the openness and transparency principles. The free access to public information has become one of the most hotly contested aspects of contemporary government and public administration. Many countries in Europe have well-established Freedom of Information laws (FOIAs), while others have adopted them more recently. The problems that occur in the implementation of FOIAs are different due to the legal and institutional context; nevertheless, patterns of best practices and malfunctioning are comparable.
