El primer ensayo, protagonizado por Cea Bermúdez, de mantener el status quo de la monarquía a raíz de la muerte de Fernando VII, acabó en un rotundo fracaso. La Reina Gobernadora encomendó a Martínez de la Rosa, viejo liberal de gran prestigio, reconducir la situación e intentar aglutinar en torno al trono frente al Pretendiente, no sólo los sectores más inmovilistas y conservadores, sino también a los liberales moderados y exaltados. La salida política de Martínez de la Rosa fue el Estatuto Real. Bajo la apariencia de restaurar las antiguas leyes fundamentales de la Monarquía, se convocaron Cortes. Se abjuraba del absolutismo para satisfacer a los liberales, pero, al mismo tiempo, la soberanía permanecía en manos del monarca. De este modo, Martínez de la Rosa creyó haber encontrando a solución política salvadora que vendría acompañada de un paquete de reformas administrativas, destinadas a modernizar la Monarquía. Los acontecimientos bélicos y la presión ejercida por los liberales más exaltados, acabaron con el proyecto político del poeta y político granadino. En este libro se hace un estudio institucional de las Cortes que surgieron y desaparecieron bajo el manto del Estatuto Real.

In his encyclical Aeterni Patris (1879), Pope Leo XIII expressed the conviction that the renewed study of the philosophical legacy of Saint Thomas Aquinas would help Catholics to engage in a dialogue with secular modernity while maintaining respect for Church doctrine and tradition. As a result, the neo-scholastic framework dominated Catholic intellectual production for nearly a century thereafter. This volume assesses the societal impact of the Thomist revival movement, with particular attention to the juridical dimension of this epistemic community. Contributions from different disciplinary backgrounds offer a multifaceted and in-depth analysis of many different networks and protagonists of the neo-scholastic movement, its institutions and periodicals, and its conceptual frameworks. Although special attention is paid to the Leuven Institute of Philosophy and Faculty of Law, the volume also discloses the neo-Thomist revival in other national and transnational contexts. By highlighting diverse aspects of its societal and legal impact, Neo-Thomism in Action argues that neo-scholasticism was neither a sterile intellectual exercise nor a monolithic movement. The book expands our understanding of how Catholic intellectual discourse communities were constructed and how they pervaded law and society during the late 19th century and the first half of the 20th century.

Cuando Fernando VII expiró en el Palacio Real de Madrid el 29 de septiembre de 1833, la silueta institucional de la Monarquía española seguía coronada por unos altos cuerpos de gobierno jurisdiccional que amenazaban con derrumbarse desde hacía mucho tiempo. El libro que el lector tiene en sus manos estudia el proceso de transformación estructural que, arrancando en la primavera de 1834 y cerrándose en el verano de 1836, unió la desaparición definitiva de los Consejos de Estado, Real de Castilla, Supremo de Indias, Supremo de Hacienda y Supremo de Guerra, con la dificultosa inauguración de un aparato de gobierno que, en una primera etapa, tuvo al peculiar Consejo Real de España e Indias en su centro. Dividida la obra en tres secciones, el autor ha dirigido cada una de ellas a analizar las distintas fases del momento que acabó resultando constitutivo de un modelo de Estado que desde entonces pasó a adjetivarse como administrativo. La primera sección indaga en el conflicto que, enfrentando a realistas moderados y reaccionarios, hundió sus raíces en el distinto modo que ambos bandos tenían de entender el gobierno de la monarquía. El de la última restauración absolutista de Fernando VII era un mundo que no tenía incorporado entre sus nociones jurídico-políticas la de una administración como sujeto y ejercicio del poder ejecutivo, por lo que las dinámicas reformistas que por primera vez trataron de introducirla encontraron en la supervivencia de los antiguos consejos una serie de obstáculos muy difíciles de superar. Poco tiempo después, a la muerte del monarca, un contexto sustancialmente distinto acogió el diseño y la puesta en práctica de las medidas que llevaron a cabo la gran transformación institucional: los reales decretos de 24 de marzo de 1834.
