Con este texto se intenta despertar en el lector la reflexión de la importancia que las instituciones jurídico-políticas tienen en nuestra vida cotidiana. Para provocar este interés, el presente trabajo incita al análisis sobre el origen y evolución del derecho constitucional en una sociedad políticamente organizada. Se aborda el tema del constitucionalismo y el estudio del poder público desde la perspectiva doctrinaria. Se toca de forma clara y sen- cilla el carácter con el que se crean las constituciones, el entramado institucional que surge de ellas, los elementos que permiten su creación, su aplicación y la manera como funciona en una sociedad regida por el derecho positivo sustentado en el marco normativo supremo. Para ello, se analizan las diferentes teorías y concepciones del derecho constitucional, para luego examinar cada uno de los aspectos que configuran la existencia de un orden jurídico supremo denominado Constitución; de esta forma, veremos qué es un poder constituyente originario, qué aspectos lo diferencian de un poder constituyente permanente, cómo se clasifican las constituciones según las reflexiones teóricas de diversos especialistas en la materia; luego, razonaremos cuáles son los aspectos que permiten que pueda crearse una ley suprema y cómo se logra que ésta sea reconocida y aceptada en una sociedad determinada.

¿Ha hecho bien la Ley Fundamental —esta es nuestra pregunta— dejando tanto poder en manos de los jueces? ¿Por qué ha tomado realmente este camino? O, dicho de otra forma: ¿Qué razones hay a favor de esta solución? ¿Qué razones hay en contra de ella, qué inconvenientes pueden verse a esta solución? ¿Cómo se han de pesar finalmente el pro y el contra? He intentado describirles la significación de nuestra jurisdicción como una fuerza llamada a la salvaguardia de la Constitución, de su sistema de valores y de su orden político. También he intentado señalar el pro y el contra de tal poder judicial. Habrá aparecido claramente que, según mi opinión, predomina el pro. Los enemigos de tal poder judicial pueden decir que no he tenido suficientemente en cuenta las objeciones y las dudas, que las he expuesto y las he rechazado de forma incompleta. Puede que así sea: la limitación basada en una previa elección era inevitable; sobre la decisión tomada por la Ley Fundamental también se podrían añadir muchas cosas que aquí tenían que ser dejadas de lado.
