"Estudio Jurídico Tributario de las Presunciones y Ficciones Legales en la Legislación Aduanera Mexicana" El Estado conforme a sus principales finalidades se encuentra aquella que busca un bienestar social sustentable para todos los individuos que se encuentran dentro de su territorio; por lo general, se logra en la medida que sean proporcionados servicios públicos que tienden a contrarrestar las necesidades sociales. Por dicho motivo se desarrolla la actividad financiera del Estado, con la cual se procura los medios económicos suficientes para poder consumar esos fines estatales. Dentro de la primera etapa financiera se encuentra el derecho tributario, encargado en regular la actividad por medio de la cual se obtienen los recursos públicos y cuyo fundamento legal se sustenta en la fracción IV del artículo 31 de la Constitución Política de los Estados Unidos Mexicanos. Por otra parte, las autoridades fiscalizadoras se encuentran facultadas conforme a la carta magna para realizar procedimientos fiscalizadores con los cuales se cerciora el pleno cumplimiento de las regulaciones tributarias y de esa manera se encuentran a las presunciones legales que son figuras que asisten a las autoridades para establecer ciertos hechos dentro del procedimientos y pueden ser de dos tipos; relativas y absolutas, las primeras admiten pruebas que revierten sus efectos, mientras que las segundas son definitivas. Así mismo, se encuentra el derecho tributario aduanero, una rama especial del área tributaria con características propias en la cual es necesaria la instauración de ficciones legales que son figuras jurídicas complejas que pretenden crear un realidad jurídica que usualmente se aleja de la verdad real.
