This research evaluates whether the new model of investment agreement developed by Brazil (CFIA) is a mechanism for enhancing protection and respect for social and economic rights. The research starts by exploring the origins of investment treaties, their development and main characteristics. It examines why investment treaties and socio-economic rights are related, by mapping cases in which investment treaties have already impaired the protection of such rights. The research then analyzes how these two issues shall be jointly handled. It considers international organizations? initiatives to regulate business and human rights and investment treaties? frameworks that foster sustainable development, as well as new investment agreements? models developed by different countries, and then suggests criteria for evaluating whether an investment treaty is adequate from the socio-economic rights standpoint. Finally, this research investigates the CFIA model, brings a brief historical overview, evaluates CFIAs? wording, and examines how some CFIAs? institutional mechanisms consider corporate social responsibility issues. In conclusion, this research asserts that the CFIA model can be a mechanism for enhancing protection and respect for socio-economic rights, but some concerns (particularly related to safeguarding States? regulatory space and providing for stronger obligations to investors and States to protect human rights) need to be addressed.

Challenges faced by pension funds today include steady increases in life expectancy, frequent changes in the accounting rules, low interest rates and poor equity market returns. It is possible to tackle the difficulties encountered by pension funds not only by raising contributions and/or reducing benefits, but also by improving the way in which pension funds invest. In spite of some changes in the past few years, Brazilian pension funds investment management remains subject to strict constraints. The findings of this study, carried out in 2007, suggest that, even though the results of conducted tests deny, to some extent, the need for further adjustments in investment regulations, concluding this way would not be accurate. There are, in fact, strong reasons to believe that the high interest rates environment experienced over the last years contaminated these results. Furthermore, with a clear downward trend in interest rates, it is possible to imply that, if nothing is done, pension funds will lack flexibility when they need it the most.

This book presents evidence of 29 countries engaging in state-sponsored actions and 85 nations acquiring cyber offensive technologies from private vendors. The numbers challenge the average perception of concentration of cyber capabilities in a few ""traditional"" actors. Cyberspace provides alternatives for the bargaining and interactions to nation-states below the threshold of the use of force. As a result, actors can achieve strategic outcomes and influence the balance of power without resorting to an armed attack and minimizing the risk of a military or nuclear response from their targets.

Numerical analysis for reservoir engineering scenarios is necessary due to the importance of predict the consequences and products of water or oil exploitation, as well as the vast quantity of variables that are associated with hydraulic engineering, oil, and rock geomechanics. Due to this, the present work consists to show the relative activities for geomechanical coupling and flux simulation based on paper SPE – 79709 of Dean et al. (2006). This way, the used software for coupling was IMEX (2019), in the explicit iterative coupling, with geomechanics and flux model of the same simulator and, posteriorly, was used the geomechanics simulator FLAC3D 6.0 associated with the flux model of IMEX and programming with MATLAB and FISH to transfer the data between simulators. In addition, the results demonstrate the satisfactory obtention of convergence of the problems proposed by Dean et al. (2006), in IMEX with geomechanics. For iterative coupling between FLAC3D and IMEX was obtained good behavior convergence of problem 1. At the end of the simulations, a reservoir model is elaborated based on this problem with the inclusion of a horizontal fracture near the region of the producing well. This type of coupling allows an accurate study with the highest level of complexity and inclusion of variables to reservoir behavior, as the inclusion of fractures and constitutive models.

The large caseloads to be tried in the courts and the dissatisfaction of jurisdictions with the judgments are the main reasons for the application of mediation in the courts. The culture of litigation and the Civil Law system applied in Brazil are driving factors in order to arise more lawsuits, given to a greater possibility of different decisions for similar situations, in contrast to the Common Law, applied in almost all of the United States, where the citizen is more cautious when filing lawsuits, because it is more difficult to reverse a precedent. Given the need to change this situation, a movement began in Brazil to encourage agreements between the parties in the process, with the National Council of Justice having issued the Resolution No. 125/2010 instituting mediation and, later, the provision of such institute by the new Code of Civil Procedure of 2015. The previous Code of Civil Procedure, from 1973, already regulated conciliation, although it does not have the same effectiveness as mediation in the resolution of conflicts in a more definitive way, especially in demands whose conflict parties have a continued relationship among themselves, such as those involving Family Law, for example. Indeed, among the different types of alternative methods of conflict resolution, mediation is within the best results. So, it is of fundamental importance the comparative study of the mediation in Brazil and the United States, analyzing the participants of mediation, the types of mediation, how it is applied in practice in each country, the advantages and disadvantages and thinking how to improve the institute of mediation in both countries, considering the differences and similarities between them.
