The term solidarity has acquired a commendable meaning of mutual responsibility, yet remains suspect because it has been invoked in too broad a spectrum of cultural contexts, ranging from fascist ideology to human rights. This essential book shows how solidarity may be – should be – conceived as a normative principle with pressing legal content, instrumental to the realisation of the social ends of today’s democratic polities. The author, for the first time in such depth, documents the interweaving of legal norms with social ideas and values, focusing on the use of the principle of solidarity in the European Union’s bodies and in its Member States. There are detailed examinations of how the principle appears in such realms as the following: national constitutions; welfare systems; regulation of contracts; social effects of legal rules; women’s rights; the social market economy; the social doctrine of the Catholic Church; affirmation of corporate social responsibility; and sustainability and corporate governance. The author describes how each context contributes to a meaningful elaboration of the concept of solidarity, thus synthesising and extending prior work on the subject. Following Kant’s dictum that the solidarity of mankind is a ‘to be or not to be; a matter of life or death’, in today's difficult and calamitous times it is appropriate to rethink the principle of solidarity as the reason for living, living fully and not just surviving, in a social agglomeration we call a community. This book examines the subject of constitutional unamendability from comparative, doctrinal, empirical, historical, political and theoretical perspectives. It explores and evaluates the legitimacy of unamendability in the various forms that exist in constitutional democracies. Modern constitutionalism has given rise to a paradox: can a constitutional amendment be unconstitutional? Today it is normatively contested but descriptively undeniable that a constitutional amendment—one that respects the formal procedures of textual alteration laid down in the constitutional text—may be invalidated for violating either a written or unwritten constitutional norm. This phenomenon of an unconstitutional constitutional amendment traces its political foundations to France and the United States, its doctrinal origins to Germany, and it has migrated in some form to all corners of the democratic world. One can trace this paradox to the concept of constitutional unamendability. Constitutional unamendability can be understood as a formally entrenched provision(s) or an informally entrenched norm that prohibits an alteration or violation of that provision or norm. An unamendable constitutional provision is impervious to formal amendment, even with supermajority or even unanimous agreement from the political actors whose consent is required to alter the constitutional text. Whether or not it is enforced, and also by whom, this prohibition raises fundamental questions implicating sovereignty, legitimacy, democracy and the rule of law.

In esso si cerca di mettere in evidenza soprattutto come nel nostro ordinamento non si sia mai avuto un vero Stato dei partiti, ma viceversa un particolare tipo di partitocrazia sregolata, che ha continuato a persistere, in forme peculiari, anche quando le formazioni politiche presenti nel sistema prima del 1992- 93 sono scomparse nella crisi di regime. Il crollo del tradizionale sistema dei partiti, che aveva dato vita al patto costituzionale del 1948, ha comportato nel tempo lo scivolamento verso una forma di democrazia non partecipata, meramente elettorale e basata, da un lato, su istanze plebiscitarie e carismatiche, dall'altro su forme di accentramento burocratico, che ne hanno attenuato progressivamente (ed in modo pericoloso) valore e standard in un quadro di indebolimento della stessa coesione comunitaria e sociale, riflettendosi sugli stessi problemi strutturali dell'ordinamento. In questo specifico ambito appare evidente come lo stesso assetto della Costituzione italiana del 1948 risulti in crisi, cosicché la Carta costituzionale, dopo circa sessanta anni di vigenza, appare a dir poco 'snervata' e al limite della rottura materiale, nonostante essa si inserisca nell¿ambito del tessuto unitario del diritto costituzionale europeo e di questo formi un tassello parziale. Il dibattito sulla natura dell'ordinamento, che ha anche coinvolto i supremi organi costituzionali, rivela l'alternativa tra perlomeno due idee della rappresentanza democratica e dello stesso Stato sociale difficilmente conciliabili tra loro e con lo stesso parco valoriale rappresentato dal patto costituzionale."

Europa vive un momento complejo. Los ritmos de la globalización económica, los avances tecnológicos, los profundos cambios sociales y las convulsiones político-institucionales por las que están pasando las democracias occidentales hacen más que necesario que nos preguntemos por las perspectivas del constitucionalismo contemporáneo. Por ello, aprovechando las efemérides del 70º aniversario de la Constitución italiana y del 40º de la Constitución española, esta obra, publicada en cinco volúmenes, recoge los trabajos de constitucionalistas europeos de distintas generaciones que abordan los desafíos que se presentan para nuestras sociedades democráticas. - El volumen I se dedica al balance y perspectivas en la Europa constitucional, con trabajos sobre la reforma de los ordenamientos constitucionales y sobre Europa en su dimensión constitucional. - El volumen II se ocupa de estudiar cuestiones relacionadas con los derechos fundamentales y su tutela. - El volumen III revisa el estado de las instituciones políticas democráticas, en particular de los sistemas parlamentarios europeos, la participación y representación políticas, y los sistemas electorales y de partidos. - El volumen IV afronta el tema de las fuentes del Derecho, los cambios en la Justicia constitucional y los desafíos para la organización territorial. - El volumen V, dedicado a los retos del constitucionalismo en el siglo XXI, desarrolla cuestiones de gran actualidad como son las relaciones con la economía y el Estado social, la revolución tecnológica y el cambio climático, la seguridad y la legalidad sancionadora, y el fenómeno religioso. Eucons es un proyecto Jean Monnet, financiado por el programa Erasmus+ de la Comisión Europea, que nace con el objeto de promover el debate académico sobre las bases constitucionales de la construcción europea. Apuesta por el reconocimiento de una “cultura constitucional común europea”, a través de la cual poder afrontar los desafíos de nuestras democracias y del proceso de integración supranacional. Este diálogo se sustenta en tres pilares: 1) rigor y excelencia académica, para lo cual se cuenta con un comité científico internacional que apoya a la organización y orienta el diseño de las actividades que se realizan; 2) carácter intergeneracional, buscando el diálogo entre las distintas generaciones de universitarios y promoviendo la participación de los más jóvenes junto a consagrados académicos; 3) dimensión europea, tanto por los temas que aborda como por los participantes e integrantes de esta red de investigadores. Este proyecto está coordinado por Germán M. Teruel Lozano, profesor de Derecho constitucional en la Universidad de Murcia; Antonio Pérez Miras, profesor de Derecho constitucional de la Universidad de Granada, y por Edoardo C. Raffiotta, profesor de Derecho constitucional de la Universidad de Bolonia. Y colaboran la Universidad de Murcia, como responsable del proyecto, la Escuela Internacional de Doctorado de la UNED, la Escuela de Doctorado de Derecho de la Universidad de Bolonia y el Seminario Italoespañol de Estudios Constitucionales. Precisamente este último, el Seminario italoespañol, fue el origen de este proyecto. El mismo se creó como un grupo de estudio en 2011 por iniciativa de jóvenes investigadores españoles e italianos, en el ámbito de colaboración entre la Universidad de Bolonia y el Real Colegio de España en Bolonia. Esta red de investigadores ha venido promoviendo la celebración de un congreso bienal desde entonces, con 4 ediciones hasta el momento: Bolonia (2012), Madrid (2014), Catania (2016) y Murcia (2018). Las cuales han dado lugar a distintas obras colectivas que han afrontado diferentes temas de actualidad constitucional: la tutela de los derechos de la persona; la integración europea o cuestiones en relación con la soberanía y la representación en la era de la globalización. El último de ellos ha sido los desafíos del constitucionalismo contemporáneo con ocasión del 70 y 40 aniversario de las Constituciones italiana y española.
