Le succes qui l'attend peut dependre de causes diverses, dont je ne suis pas bon juge; mais je n'admets aucune fin de non-recevoir contre son oppor tunite. Malgre le merite superieur de Pothier, il ne lui a pas ete donne de tracer les limites de la science. Entre son siecle et le notre viennent se placer quarante annees de regeneration sociale, qui ont fait eclore des interets nouveaux, et des Codes qui les consacrent. Le progres, qui est partout, a aussi penetre dans lajuris prudence, et la science des lois s'est retrempee dans une revolution qui ailleurs a pu faire peubetre trop de ruines, mais qui, pour elle a ete une epoque de creation ou de perfectionnement. Or, pour des theo ries si souvent Opposees a celles qui les ont precedees, on ne saurait se passer d'interpretes contemporains. Pensons-y bien! Le Code n'a pas toujours vecu d'em prunts. Il a aussi son originalite, et de profondes innovations doivent nous mettre en garde contre l'a nachronismc.
