La controverse contemporaine qui s’élève au sujet de l’épistémologie de la discipline du droit comparé nourrit une interrogation relevant de la théorie générale du droit. Si l’on postule qu’ils sont distincts l’un de l’autre, droit comparé et théorie générale du droit peuvent entretenir deux types de rapports. Selon une approche inductive, le droit comparé fournit, en définissant des invariants du phénomène juridique, la matière d’une théorie du droit applicable à tous les ordres juridiques. Selon une approche déductive, c’est au contraire la théorie du droit qui, par les concepts généraux qu’elle fournit au comparatiste, permet l’étude d’une pluralité de droits positifs. Or aucune de ces deux démarches n’échappe à des difficultés considérables. La première suppose nécessairement, en amont de la comparaison, que le juriste soit doté de concepts théoriques, la seconde ne peut s’appuyer sur une théorie du droit parfaitement neutre et détachée de tout ordre juridique positif. Afin d’échapper à l’antinomie qui conduit, pour répondre à l’une de ces deux séries d’objections, à s’exposer un peu plus à l’autre, une métaméthodologie d’orientation pragmatiste est explorée. Du point de vue des difficultés gnoséologiques, celle-ci propose une vision cohérentiste, fondée sur une interaction constante des concepts et des objets au sein de l’enquête juridique. Du point de vue du risque d’ethnocentrisme qu’affronte tout comparatiste, elle renonce à toute perspective de surplomb et invite, précisément à travers l’opération comparatiste, à une prise de conscience réflexive des présupposés non scientifiques de toute démarche scientifique.
