L'opera è divisa in due tomi: Il primo tomo tratta del contratto di locazione considerato sotto il profilo tecnico-giuridico. Vengono analizzate la natura e le caratteristiche di questo istituto come definito dal codice civile, rilevandone le differenze da altri, quali, ad es., il comodato, il noleggio e l’affitto, con i quali la locazione presenta qualche analogia. Si passa poi ad analizzare la fase di formazione del contratto ed i suoi requisiti di validità e di efficacia, in base alla normativa speciale, nettamente prevalente e in massima parte inderogabile. Il secondo tomo analizza i profili processuali delle controversie involgenti i rapporti locatizi, nel duplice aspetto della cognizione e dell’esecuzione. Viene dedicato spazio alla tutela ordinaria di cognizione, nella forma del rito speciale locatizio, a quella speciale, nella forma del procedimento per convalida di sfratto, al procedimento monitorio, al procedimento di rilascio. In questa seconda edizione hanno trovato ampio spazio la disamina del procedimento sommario di cognizione ove ritenuto compatibile con le liti locative e quello di mediazione delle controversie in oggetto, quale condizione di procedibilità del giudizio (di cui al d.lg. n. 28 del 2010 e successive integrazioni). I procedimenti di esecuzione forzata sono analizzati non solo nella regolamentazione codicistica, ma pure nella disciplina rinvenibile nella legislazione speciale, ampiamente derogatoria del regime “ordinario”.
