Le présent ouvrage fait suite au colloque du droit de la responsabilité civile qui a eu lieu à Fribourg le 8 novembre 2019 sous la direction de Franz Werro, Pascal Pichonnaz et Christine Chappuis. Il réunit les contributions présentées à cette occasion sur le nouveau droit de la prescription, entré en vigueur le 1er janvier 2020. Les contributions ici reproduites ont d'abord pour objet quelques aspects saillants de la réforme du droit de la prescription. Elles analysent ensuite successivement la suspension des délais de prescription, la renonciation à invoquer la prescription, les délais de l'action récursoire et l'impact du nouveau droit sur les contrats en cours. Le livre entend aussi présenter une critique des ombres et des lumières des nouvelles règles. En exergue, on signalera qu'on a réglé de manière insatisfaisante la question des dommages tardifs et également compromis l'utilité du régime de la renonciation à la prescription, en laissant subsister d'importantes incertitudes sur les effets de cette renonciation et en prévoyant dans le même temps que les parties peuvent dorénavant prévoir par écrit une suspension de la prescription durant leurs négociations.

The 2005 Avant-projet de réforme du droit des obligations et de la prescription, also dubbed the Avant-projet Catala, suggests the most far-reaching reform of the French Civil code since it came into force in 1804. It reviews central aspects of contract law, the law of delict and the law of unjustified enrichment.
