Il saggio monografico di Alessandro Grillone, allievo della Scuola romanistica pisana, costituisce un’ulteriore testimonianza, qualora ve ne fosse ancora bisogno, dell’importanza, negli studi giuridici, anche di diritto positivo, della prospettiva storica e, nello stesso tempo, della necessità di condurre l’indagine storica del diritto attraverso una continua comparazione con il presente. Come è noto, tanto da costituire parametro di valutazione nelle abilitazioni all’insegnamento, la comparazione con gli altri ordinamenti, particolarmente dell’Unione europea, costituisce elemento centrale della ricerca di diritto positivo. Il presente contributo dimostra come anche la comparazione storica debba avere la stessa centralità, nonostante il rilievo troppo spesso sottovalutato nella valutazione scientifica. In fondo il diritto è una stratificazione storica che la norma di diritto positivo rappresenta e nella quale, attraverso una complessa e consapevole indagine, è possibile, come nella ricerca scientifica degli strati archeologici, ricavarne le ragioni profonde e quindi la stessa ratio. È solo così possibile capire che il diritto fallimentare, oggi si direbbe, in attesa dell’entrata in vigore del nuovo codice, il diritto della crisi dell’impresa e dell’insolvenza, non ha matrice storica – come superficialmente si potrebbe pensare – nell’epoca delle grandi codificazioni illuministiche e del libero mercato.

The emergence of a European private law is one of the great issues on the legal agenda of our time.
