Excerpt from Leading Cases and Statutes on the Law of Evidence This book was originally intended for the use of students only. I now find, however, that it has been extensively used by practitioners, especially at Quarter Sessions, as presenting, in a handy form, the substance of cases constantly referred to. In order to make it more worthy of the attention thus bestowed on it, I have now considerably supplemented it. The chief additional feature of this edition is the collection of Statutes on Evidence, forming Part II. Of the book. I have taken much trouble to select all the important statutory provisions relating to evidence, including those contained in statutes dealing with other matters but having special provisions as to evidence. I believe this collection to be the fullest in existence on the subject. I have not attempted to make it absolutely complete, as it would be useless, and wasteful of space, to insert some of the provisions on special matters. But I believe that every statutory provision on the subject, likely to be required, will be found in the collection, except those relating to procedure, with which I do not profess to deal. Some of the provisions given are of small importance in themselves, but they serve to illustrate points or rules stated in other portions of the book. Excerpt from Leading Cases on the Law of Evidence With Notes It is believed that this table of contents, read together with the headnotes, will give a fairly complete outline of the Law of Evidence. With regard to the facts involved in the cases, in some instances they do not appear in the Reports, the point of Evidence only being stated. In other cases the facts are quite immaterial to the point of Evidence involved, and it has been thought better to omit them, together with such portions of the judgments as refer only to such facts and throw no light upon the point of Evidence. Excerpt from Leading Statutes Summarised: For the Use of Students The object of the present little work is to afford to the law-student, on his making a first acquaintance with the Statute book, a guide to its most important chapters. But it is not only an enumeration of these chapters: it is also a summary of them. The student has to contend not only with the great bulk of Statute law, but also with the way in which very much of it is drawn. As it has been put by Sir James Stephen recently, the sections of an Act of Parliament "consist of single sentences of enormous length, drawn up, not with a view to communicating information easily to the reader, but to prevent a person bent upon doing so from wilfully misunderstanding them." The summary here presented is not designed to supersede the necessity of a direct reference by the student to the Statutes themselves. Excerpt from The Law of Evidence I have, as far as practicable, adhered to one uniform method of arrangement throughout - that of stating: (1) The rules of evidence; (2) the principles upon which they are founded; (3) their various limitations; and (4) the illustrations to the rules. The latter have, for the convenience of the reader, been arranged not only in separate columns according to their admissibility or the reverse, but, wherever. Po'ssible, in pairs, which present analogous facts but different decisions, the contrasted cases being placed side by side at the same height in the page. Excerpt from The Complete Practice of the Law of England, as Established by the Recent Statutes, Orders, Rules, &C, Vol. 2: The Practice of the Law of Evidence IN this Treatise on the Practice of the Law of Evi dence I have endeavoured to state, clearly and concisely, all those principles of this branch of law which are of most frequent and practical importance in the Courts. It is apparent that a compendium of a subject which has been exhausted by such writers as Phillipps, Taylor, Starkie, and Roscoe, can have little pretension to originality, and I am bound to acknowledge the great extent of my obligation to all these authors, and especially to the elaborate works of the two former gentlemen. There are few legal topics which afford a modern writer any ground for claiming the merit of originality in the treatment of them and I have no wish to advance any such claim. At the same time, I may be permitted to disclaim all intentional plagiarism, and to state, that whenever I have availed myself of the learning and labours of my predecessors, I have studious] y acknowledged, and beg to repeat my acknow ledgment of, the debt. The plan of stating fundamental principles, and of illustrating them by leading cases, is, perhaps, to a certain extent, original; and I may also add, that I have endeavoured anxiously to mark dis [evl] A. Excerpt from The Principles and Practice of the Law of Evidence N preparing this Edition for the Press we have not departed from the lines on which the previous Editions were based. We have considered all the cases upon the subjects dealt with in this Book which have been reported since the last Edition down to April, 1904, and have incorporated such of them as we deemed of sufficient importance in this Edition, and have also incorporated a few cases reported since that date. We have eliminated certain matters mainly of historical interest, and have other wise compressed the present Edition, so that in spite of the very considerable amount of new matter introduced into this Edition it will be found to be shorter by several pages than the previous Edition. Excerpt from Cases on the Law of Evidence: Selected and Arranged The chief criticism of this method of instruction is that too much ground has to be covered for the amount of knowledge acquired. This criticism applies with greater force to long cases. In the present volume the cases are short and confined to the points of Evidence involved. All matter contained in the reported cases not pertaining to Evidence has been eliminated. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
