This book explores the ways language is used by the professional legal community for the communication of its main business - the negotiation of justice - in today’s globalized world. The volume addresses three main aspects of language use in the negotiation of justice. Beginning with the legal contexts of litigation, arbitration and mediation, the book moves on to discuss the main issues identified in those contexts and finally it explores the applications of legal linguistics. These three aspects are studied across the themes of analyses of legal discourse and genres, issues of power and ideology in the use of legal language, cross-cultural legal communication, questions of recontextualization, accessibility and plain language, law and disciplinary identity, and pedagogy of legal language. With chapters set across a variety of jurisdictions, the contributions offer analytical insights into the interface between law and language. The book is a valuable resource for those in the legal community wishing to increase their understanding of the use of language for the negotiation of justice.

This book discusses the proper use of legal language in business communication. While communicating, a business leader has to bear in mind the relevant legal framework, and be sure to never violate it. However, legal language in itself can be so complex and difficult that it is often unclear as to what meaning can be ascribed to different words and phrases used in a particular context. Also, while it’s easy to say that there are certain limits to the law, those limits are not readily visible to the uninitiated; occasionally, even experts flounder. Exploring precisely these topics, the book will be of interest to students of business, law, and business communication; managers; lawyers; researchers; practitioners; and general readers alike.

Based on the Socratic dialogue method, Talking about Communication Law provides the fundamentals for discussing controversial issues in communication law and asks thought-provoking questions to promote debate. Providing the basic framework of the law with discussions focusing on the major cases in each area, Talking about Communication Law begins with the material related to the First Amendment's free speech and free press clauses, then proceeds through the various topics derived from those freedoms, including libel, privacy, access to information, the media and the courts, broadcast regulation, intellectual property, and business communication. Conciseness and clear language are its strengths, as are its readability and engaging approach. Point-counterpoint essays, frequently asked questions, chapter glossaries, and case problems encourage students to take an active approach to learning and create a running dialogue with the reader. The first one-third of the book deals with the First Amendment as applied to political speech, campus issues, and sexual expression. The second one-third deals with issues in journalism, broadcasting, and cyberspace. The last one-third deals with issues related to communication in business, such as advertising, public relations, and intellectual property.

Bachelor Thesis from the year 2018 in the subject Psychology - Work, Business, Organisational and Economic Psychology, grade: 1,3, University of Applied Management, language: English, abstract: Legal English plays a major role for communication and practicing in law firms globally. Offices involved in international jurisdictions are reliant on this language and its use affects the outcome of processes, lawsuits and even success rates. Several studies confirm that English as the lingua franca is a major influencing factor in determining employment and even wage for the concerned person. Quite a lot references concerning this special language serve the purpose of supporting law students in their classes. It is noticeable that most of those resources are designated to academic purposes only. The importance of English Legalese needs to be further analyzed and emphasized. For practicing lawyers and attorneys, it may be fundamental to be aware of the impact of correct language use and this also applies to foreign speakers as well. This thesis examines the role of English Legalese in the legal context for law firms not only residing in an Anglophone area. In order to debate this essential question, a definition of its peculiar features, a historical background and the demonstration of the differences between Standard English and this specific language represent the needed requirements to analyze the role of English Legalese in detail. As already stated, nowadays English is a frequently used language for legal purposes and there have to be certain reasons why it has gained this big recognition. The thesis gives some relevant reasons why applying this language is a very efficient process, yet the downsides of using a very specific language need to be considered. Therefore, the subsequent part of this thesis discusses why it might not be ideal to solely apply English as the preliminary language, or even having one dominant language in general. This analysis can be seen as a prerequisite for conducting the methodical part of the thesis. It analyzes the importance of legal English for international active lawyers from several countries around the world. Therefore, relevant data will be assembled, analyzed and interpreted. The results will help to determine the importance of Legal English for international Law firms and for practicing lawyers today.

Today, it has been said, the world is "flat," as online media allow information to move easily from point to point across the earth. International legal differences, however, are increasingly affecting the ease with which data and ideas can be shared across nations. Copyright law, for example, affects the international flow of materials by stipulating who has the right to replicate or to share certain kinds of content. Similarly, perspectives on privacy rights can differ from nation to nation and affect how personal information is shared globally. Moreover, national laws can affect the exchange of ideas by stipulating the language in which information must be presented in different geopolitical regions. Today's technical communicators need to understand how legal factors can affect communication practices if they wish to work effectively in global contexts. This collection provides an overview of different legal aspects that technical communicators might encounter when creating materials or sharing information in international environments. Through addressing topics ranging from privacy rights and information exchange to the legalities of business practices in virtual worlds and perspectives on authorship and ownership, the contributors to this volume examine a variety of communication-based legal issues that can cause problems or miscommunication in international interactions. Reviewing such topics from different perspectives, the authors collectively provide ideas that could serve as a foundation for creating best practices on or for engaging in future research in the area of legal issues in international settings.

There are multiple aspects of electronically-mediated communication that influence and have strong implications for legal practice. This volume focuses on three major aspects of mediated communication through social media. Part I examines social media and the legal community. It explores how this has influenced professional legal discourse and practice, contributing to the popularity of internet-based legal research, counselling and assistance through online services offering explanations of law, preparing documents, providing evidence, and even encouraging electronically mediated alternative dispute resolution. Part II looks at the use of social media for client empowerment. It examines how it has taken legal practice from a formal and distinct business to one that is publicly informative and accessible. Part III discusses the way forward, exploring the opportunities and challenges. Based on cases from legal practice in diverse jurisdictions, the book highlights key issues as well as implications for legal practitioners on the one hand, and clients on the other. The book will be a valuable reference for international scholars in law and other socio-legal studies, discourse analysis, and practitioners in legal and alternative dispute resolution contexts.
