This ambitious book examines the notion of legal transparency from a unique cultural and historical perspective. Drawing from their combined academic and practical experience with both Chinese and Western legal traditions, authors John Head and Xing Lijuan explore how an intense debate -- pitting legal transparency against legal opaqueness -- unfolded in dynastic Chinese law, which began in the dark mists of history and ended formally just over a hundred years ago. They rely on a wide range of both Western and Chinese sources to explain how that great debate was resolved in the early Han Dynasty (around the third century BCE) in a way that molded Chinese law into a sophisticated legal system that for roughly two millennia balanced definitiveness with vagueness, predictability with flexibility, and egalitarianism with privilege -- and that reflected cultural values still resonating in China today. Legal Transparency in Dynastic China presents a clear narrative that assumes no prior expertise in Chinese law or history, and it caters to readers interested in issues of good governance, comparative studies, China, history, and law. The book begins by defining "legal transparency" and explaining where it fits into the larger context of the transparency-in-government movement that has gained such momentum in recent years, especially at the urging of Western powers. Then the book explains the fundamentally different values espoused by early Confucianists, for whom society is best governed not through written law but through the exemplary behavior of a highly educated, virtuous, and enlightened elite. After tracing the political and ideological challenges that the Confucianists faced from the Legalists, Head and Xing examine the compromise that resulted in the so-called "Confucianization of the Law" around 200 BCE. They then show how that alloy of competing ideologies characterized Chinese dynastic law for many centuries, resulting in what some would consider the most enduring and effective legal system in human history.

Based on the Judicial Transparency Index Assessment (2019 and 2020) conducted in China by the Institute of Law of the Chinese Academy of Social Sciences, this book summarizes and analyzes the current situation of judicial openness in China, using a sample of 218 courts across the country for the study. The book analyzes the ideological and institutional origins of judicial openness and examines the operation of judicial openness through the practical experience of role replacement. By analyzing evaluation data in the fields of audit information disclosure, trial information disclosure, judicial enforcement data disclosure, and judicial reform data disclosure, the book points out that the current judicial disclosure has made significant progress, but there are still problems such as unclear disclosure standards, insufficient rigidity in disclosure requirements, and the scope of disclosure still needs to be expanded. The book recommends accelerating the disclosure of judicial legislation, public standards, and strengthening assessment and accountability.

This volume addresses the major questions surrounding a concept that has become ubiquitous in the media and in civil society as well as in political and economic discourses in recent years, and which is demanded with increasing frequency: transparency. How can society deal with increasing and often diverging demands and expectations of transparency? What role can different political and civil society actors play in processes of producing, or preventing, transparency? Where are the limits of transparency and how are these boundaries negotiated? What is the relationship of transparency to processes of social change, as well as systems of social surveillance and control? Engaging with transparency as an interrelated product of law, politics, economics and culture, this interdisciplinary volume explores the ambiguities and contradictions, as well as the social and political dilemmas, that the age of transparency has unleashed. As such it will appeal to researchers across the social sciences and humanities with interests in politics, history, sociology, civil society, citizenship, public policy, criminology and law.

Law Codes In Dynastic China written by John Warren Head and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2005 with Law categories.

In telling the story of Law Codes in Dynastic China, John Head and Yanping Wang offer a bird's eye view of Chinese legal history from the earliest dynasties to the last. They survey the majestic sweep of China's legal tradition by allowing the details to emerge from the works of many scholars and then connecting those details in a storyline that revolves around a unifying theme: legal codification. In this way, Law Codes in Dynastic China brings to life such characters as the Duke of Zhou, Confucius, Khubilai Khan, and dozens of other emperors, rebels, scholars, and eunuchs. The book also illuminates the great movements and philosophies of China -- Imperial Confucianism, Legalism, correlative cosmology, Daoism, and others -- all in order to reveal both the spirit and the practicalities of law in dynastic China. This new one-volume text will prove valuable not only for researchers in the areas of Chinese law, legal history, and Chinese history, but also for students in a variety of undergraduate and graduate programs and for legal practitioners whose work calls for them to have a historically-based understanding of China's legal culture. For all readers, the book provides comprehensive citation to authorities and sources for further study -- with special emphasis on recent findings and translations. Moreover, for the general lay reader, the book offers a fascinating look at the intersection of three paths of literature and learning: law, history, and China. In doing so, it facilitates a broader appreciation of contemporary China as well. "I have never enjoyed reading a book of History so much since Terry Jones' The Crusades. However, it is also a serious book. Despite the breaktaking speed with which the authors drag the reader through the highs and lows of Dynastic China, the authors are careful in their presentation and are faithful to the sources... a useful sourcebook for researchers as well as an entertaining read." -- Law & Politics Book Review

Lo Jung-pang argues that during each of the three periods when imperial China embarked on maritime enterprises (the Qin and Han dynasties, the Sui and early Tang dynasties, and Song, Yuan, and early Ming dynasties), coastal states took the initiative at a time when China was divided, maritime trade and exploration subsequently peaked when China was strong and unified, and declined as Chinese power weakened. At such times, China's people became absorbed by internal affairs, and state policy focused on threats from the north and the west. These cycles of maritime activity, each lasting roughly five hundred years, corresponded with cycles of cohesion and division, strength and weakness, prosperity and impoverishment, expansion and contraction. In the early 21st century, a strong and outward looking China is again building up its navy and seeking maritime dominance, with important implications for trade, diplomacy and naval affairs. Events will not necessarily follow the same course as in the past, but Lo Jung-pang's analysis suggests useful questions for the study of events as they unfold and decades to come.
