If subjecting war to law is one of the most important legal achievements of the 20th century, progressing further in that direction is one of the most important challenges for the 21st century. Com a entrada em vigor da Lei 9.299/1996 começaram a surgir divergências doutrinárias e jurisprudenciais em torno da constitucionalidade do §2º, do art. 82 do Código de Processo Penal Militar, acrescido por aquela Lei. Destarte, foram ajuizadas duas ações diretas de inconstitucionalidades: ADI 1.494/1997 e ADI 4.164/2008, a primeira foi extinta sem resolução do mérito e a segunda está aguardando julgamento. Recentemente foi promulgada a Lei 13.491, de 13 de outubro de 2017, a qual alterou, novamente, o art. 9º, do Código Penal Militar e atiçou, ainda mais, a celeuma em torno do tema. Dessa forma, ainda hoje persistem tais divergências. Assim, o objetivo desse trabalho é analisar qual instituição policial tem atribuição para investigar os crimes dolosos contra a vida praticados por militares dos estados contra civis. A pesquisa será na abordagem qualitativa, os procedimentos técnicos utilizados serão do tipo pesquisa bibliográfica, com a finalidade de recolher informações para análise das diversas posições acerca do problema da pesquisa. Por fim, como se pode constatar, o tema é polêmico e atual, pois, ainda, persistem tais divergências, inclusive, se tais crimes seriam militares ou comuns, daí a necessidade de analisar, com base na doutrina e na jurisprudência, a qual instituição policial compete investigar tais crimes.
