“Menores de edad, pero, también y, ante todo, personas. Aun con vaivenes hacia una u otra consideración, como persona y como menor, el Derecho se ha mantenido a lo largo de toda su historia en una difícil balanza ante tal dilema: entre la necesidad de proteger a los menores de edad por su falta o menor madurez y autosuficiencia y la de reconocerles cierta autonomía como personas que -también y, ante todo- son. “Hoy las aguas del Derecho parecen -en parte- volver a su cauce -tal vez el natural-, al menos a sus orígenes, aunque, por supuesto, de un modo renovado, acorde a los tiempos actuales (distinguiéndose, por ejemplo, entre niños y niñas, infancia y adolescencia. No se olvida, desde luego, la necesidad de proteger al menor de edad en caso de conflictos de intereses, anteponiendo los suyos a los de cualquier otro que no sean los propios del menor: ahí está el consabido ‘interés superior del menor’ en tantos textos nacionales e internacionales consagrado".
