Reforms introduced in 2009 to the Family Law Act 1975 (Cth) have meant that most same-sex and opposite-sex de facto couples (in all states and territories except Western Australia) who end their relationships can now have their property and financial matters dealt with in substantially the same way as married people. This paper aims to provide non-legal professionals in the family law sector with a general outline of the relevant reforms, their genesis, and the arguments in favour of and against their introduction.

Marriage And Values In Public Policy written by Elizabeth van Acker and has been published by Taylor & Francis this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-01-20 with Political Science categories.

Marriage is a site of political conflict. It is a controversial issue in the UK, Australia and the US where there is a clash of values between neoliberal governments and diverse groups either strongly opposing or supporting marriage. In the meantime, fewer couples are marrying, while other family forms are more widely accepted. This book explores this disconnect by examining policy issues such as class divides, ethnicity, religion, same-sex marriage, gender relations and romantic expectations. A top down approach explores different government policy responses to marriage. In all three countries, there are differences and similarities in how governments react to the changes in family formations, but values or ‘conceptions of the desirable’ play a significant role. Enhancing stability and commitment as well as personal responsibility are important for policymakers who aim to keep ‘the family’ intact and thereby lower the burden on the public purse. It is difficult for political actors to respond to conflicting and changing values surrounding the diversity in relationships or to translate them into policies. There is a strong case to be made for increased policy attention to adult relationships - and a much weaker case for marriage. Rich evidence is drawn from interviews with key stakeholders as well as politicians’ speeches, government departmental reports, stakeholders’ documents and responses to government policies, and media articles.

Comparative in both approach and framework, Family Law, Sex and Society provides a critical exposition of key areas in family law, exploring their evolution and development within their historical, cultural, political and legal context. Cross-referencing to English law throughout, this comparative textbook pays particular attention to the transformation of marriage; the development of divorce laws; matrimonial property; the legal recognition of unmarried heterosexual and same-sex cohabitants; the universal adoption of the best interests standard for children in domestic and international legislation; and the impact of the Human Rights Act 1998 on family law in a variety of jurisdictions. Divided into different sections, Family Law, Sex and Society includes coverage of: a jurisdictional and historical survey of some of the main themes in Family Law, as well as consideration of the evolution of the Western family the English law relating to divorce, marital property and children and a comparison with the equivalent law in the civil law jurisdictions of France and Germany family law developments in other common law countries such as Australia and New Zealand, selected American jurisdictions, parts of Africa and some Far Eastern countries; and hybrid jurisdictions like Japan and Russia an analysis of the law relating to unmarried cohabitation and domestic partnerships in civil law jurisdictions such as France, Germany and Sweden in comparison to Anglo-American law a comparative analysis of the laws relating to domestic violence. Family Law, Sex and Society offers valuable socio-legal and socio-cultural insights into the practice of family law, and is the only textbook that provides a unified, coherent and comparative approach to the study of family law as it operates in these particular jurisdictions.
