Scientific Essay from the year 2013 in the subject Communications - Journalism, Journalism Professions, , course: None, language: English, abstract: A free press is the cornerstone of a democratic society. It has been said that liberty depends on the freedom of the press. However, when these freedoms and rights are left unrestricted or without borders there are likely to be abuses. This write-up looks to figure out the provisions in the 1992 constitution that protect the independence and freedom of the press and also try to find out if there are other provisions in the constitution as well as other legal documents that act as checks on these rights and freedoms. The write-up will later examine situations that could warrant deliberate restrictions on media freedom. The write-up has been organized into seven sub-headings namely; article 162 of the 1992 constitution, the media, brief history of the media in Ghana, press freedom and the role of the media in Ghana, the need for press freedom in Ghana, abuses of press freedom in Ghana and circumstances that would warrant restrictions on the media without jeopardizing the human rights of Ghanaians.

For example, recent events at the Ghana Broadcasting Corporation where the removal of the Board by the National Media Commission (NMC) raised concerns about the role of the Commission simply heighten the importance and urgency of such a quest. [...] The title of the book suggests that it is a 'source book.' To be specific, it is a publication for sourcing legislation relating to the media, speech and expression in Ghana. [...] The value to the media practitioner, though, is so great that one wonders whether the NMC would not consider directing the governing bodies of the state-owned media establishments to procure a copy for each journalist working in those establishments. [...] How times have changed! The preceding comments, notwithstanding, the introduction is one of the reasons why readers should be grateful to the author and the publishers for this invaluable book. [...] As the late Justice Afreh wrote in his foreword to the book, this book provides the 'raw material.' All who want to dig into, study, and understand the history and the evolution of law-making relating to the media and speech issues in Ghana will find this book a one-stop shop.

European Convention on Human Rights – Article 10 – Freedom of expression 1. Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers. This article shall not prevent States from requiring the licensing of broadcasting, television or cinema enterprises. 2. The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary. In the context of an effective democracy and respect for human rights mentioned in the Preamble to the European Convention on Human Rights, freedom of expression is not only important in its own right, but it also plays a central part in the protection of other rights under the Convention. Without a broad guarantee of the right to freedom of expression protected by independent and impartial courts, there is no free country, there is no democracy. This general proposition is undeniable. This handbook is a practical tool for legal professionals from Council of Europe member states who wish to strengthen their skills in applying the European Convention on Human Rights and the case law of the European Court of Human Rights in their daily work.

The media plays an intricate role in the political economy of developing nations as it conveys the social issues and impacts of a government’s legislation and policy. However, information is often miscommunicated or biased in emergent economies as media owners often tailor news and advertisements to promote their own agendas rather than meet the needs of citizens. Political Influence of the Media in Developing Countries analyzes the use and structure of media in political forums in developing nations. Featuring research on the effects of the media on news consumption and the professional and ethical difficulties journalists and editors face in the dissemination of political messages, this publication is an essential reference source for policy makers, academicians, politicians, students, and researchers interested in the adoption of various media formats used to promote the political environment and civic engagement within developing countries.

From 2005 to 2008, the British Institute of International and Comparative Law has been conducting a comprehensive project on human rights in the Islamic Republic of Iran. The project's focus was to promote human rights as a central part of the dialogue in which the European Union and Iran have been engaged since 2002. This publication is one of the outputs of that project. It is designed as a practical guide and reference book for lawyers and other human rights defenders, and it describes the international legal framework of human rights. This account of the fundamental principles of treaty law and practice facilitates better understanding of the structure and functioning of the human rights system at the international level. Focus is then placed on selected individual human rights and on the issues encountered by vulnerable groups, on the basis of significance of the topics to both parties to the dialogue. In each section, analysis is accompanied by the relevant provisions of international human rights instruments and case law. The book concludes with a list of bibliographical sources suggested for further reading.
