This volume proposes a new way of understanding the policymaking process in the United States by examining the complex interactions among the three branches of government, executive, legislative, and judicial. Collectively across the chapters a central theme emerges, that the U.S. Constitution has created a policymaking process characterized by ongoing interaction among competing institutions with overlapping responsibilities and different constituencies, one in which no branch plays a single static part. At different times and under various conditions, all governing institutions have a distinct role in making policy, as well as in enforcing and legitimizing it. This concept overthrows the classic theories of the separation of powers and of policymaking and implementation (specifically the principal-agent theory, in which Congress and the presidency are the principals who create laws, and the bureaucracy and the courts are the agents who implement the laws, if they are constitutional). The book opens by introducing the concept of adversarial legalism, which proposes that the American mindset of frequent legal challenges to legislation by political opponents and special interests creates a policymaking process different from and more complicated than other parliamentary democracies. The chapters then examine in depth the dynamics among the branches, primarily at the national level but also considering state and local policymaking. Originally conceived of as a textbook, because no book exists that looks at the interplay of all three branches, it should also have significant impact on scholarship about national lawmaking, national politics, and constitutional law. Analysing the conditions under which governments are more likely to present an executive law or a government bill, this book addresses a central aspect of the decision-making process of public policies. Drafting legislation is an important action to achieve specific policy goals, and the path chosen for this process is part of governmental strategy. This book presents a new theoretical explanation of how executives wield legislative power, based in a formal model. The model is tested using new data from Portugal. It shows that in political systems where one of the political actors has veto powers which can easily be overridden, the type of parliamentary majority is the main consideration for the government's choice of legislative instrument. More specifically, when a government does not have the majority in parliament it is more likely to propose an executive law, and contrary, when a government has a majority in parliament, it is more likely to propose a government bill.

In contemporary Japan, a great and increasing number of policy theorists and practitioners have engaged in law-related study, and many jurists have got involved in policy-oriented research. There are three major areas of law and public policy. The first field is that of legislative study, which covers the legislative process and technical skills used in the process. The second is the policy-oriented administration of laws by local government officials. The third is the domain of law and policy, which broadly refers to the branch of knowledge that studies policy design in terms of law. Despite their remarkable development in the past three decades, few attempts have been made to review the three areas in the literature of comparative policy analysis in the English-speaking world, much less ones to examine them in depth. To fill this gap in the literature, this chapter discusses the history, current state, and prospect of legislative study, policy-oriented legal administration, and law and policy. I begin with a look at the development and divisions of legislative study, while sketching the course of enactment in Japan. Next, an overview of the policy-oriented local administration of law and its background is provided. Then, I offer a survey of law and policy, with special reference to a related field, namely law and economics. Furthermore, I proceed to identify three contemporary features of the areas previously reviewed and to suggest remedies for the weaknesses involved in some of these features. The chapter concludes by pointing out the implications that these domains of Japanese law and public policy might have for other societies.
