Legitimitat ist eines der klassischen Themen der Politikwissenschaft. Die Uberzeu gung, dag es fiir die Politik wie fiir die Politikwissenschaft auch ein aktuelles Thema sei, hat die deutsche Vereinigung fiir Politische Wissenschaft veranlagt, ihm einen Kongreg zu widmen. Es braucht nicht verschwiegen zu werden, dag die Hoffnung eine Rolle spielte, gerade diese Weite des Gegenstandes werde Moglichkeiten der Diskussion zwischen den Lagern, in die die Zunft im letzten halben J ahrzehnt zerfallen ist, er offnen. Konnte, was fiir aile ein Thema ist, nicht auch ein Thema sein, iiber das man miteinander debattieren kann? Was immer man von solchen Hoffnungen halten mag, kaum jemand wird leugnen, dag zu sehr optimistischen Urteilen iiber den Zustand der Politikwissenschaft in der Bundesrepublik Deutschland, genauer: iiber die Verfassung der Zunft auch nach Duisburg nur wenig Anlag gegeben ist. Dieses skeptische Urteil besagt natiirlich keineswegs, dag es zu einer Art von Stillstand in der Wissenschaft gekommen sei oder auch nur, dag ein solcher Stillstand befiirchtet werden miisse. Der vorliegende Band beweist, dag es nicht so ist.

Back in 1972, German political sociologist Claus Offe published a book on the Structural Problems of Late Capitalism which, for almost two decades, inspired and stimulated an international and transdisciplinary debate on the role of the state in contemporary capitalism. An academic debate which, paradoxically, began to wane as the issues about which Offe had been writing became even more prominent: the "Contradictions of the Welfare State" (the title of a collection of Offe’s main contributions to the debate published in English in 1984) and democratic capitalism’s reality of the permanent "crises of crisis management". Since 2008, it has again become a widely shared diagnosis that advanced capitalism is in crisis. However, there is either scholarly disagreement or (more often so) mere perplexity when it comes to understanding this crisis and to explaining the prevalent patterns in dealing with it. In this volume, Jens Borchert and Stephan Lessenich critically combine a reconstruction Claus Offe’s approach to state theory with an analysis of the current constellation of democratic capitalism based on that same theory. In doing so, they expertly argue that his relational approach to state theory is much better equipped analytically to grasp the contradictory dynamics of the financial crisis and its political regulation than competing contributions. This is why systematically revisiting the theory of "late capitalism" is not only of a historical concern, but constitutes an essential contribution to a political sociology of our time.

It gives me great pleasure to offer this foreword to the present work of my admired friend and respected colleague Ota Weinberger. Apart from the essays of his which were published in our joint work An Institutional Theory of Law: New Approaches to Legal Positivism in 1986, relatively little of Wein berger's work is available in English. This is the more to be regretted, since his is work of particular interest to jurists of the English-speaking world both in view of its origins and in respect of its content As to its origins, Weinberger war reared as a student of the Pure Theory of Law, a theory which in its Kelsenian form has aroused very great interest and has had considerable influence among anglophoone scholars -perhaps even more than in the Germanic countries. Less well known is the fact that the Pure Theory itself divided into two schools, that of Vienna and that of Brno. It was in the Brno school of Frantisek Weyr that Weinberger's legal theory found its early formation, and perhaps from that early influence one can trace his continuing insistence on the dual character of legal norms -both as genuinely normative and yet at the same time having real social existence.
