Thèse de Master de l’année 2015 dans le domaine Politique - Sujet: Droit international et les droits de l'homme, , langue: Français, résumé: La question principale de notre étude peut se formuler ainsi: Comment les opérations de maintien de la paix contribuent-elles à la protection des droits de l’homme ? Il sera donc question de bâtir notre développement autour de cette interrogation fondamentale. La vérification et la clarification de cette question fondamentale, commandent sans doute que l’on envisage une hypothèse de recherche dans cette réflexion. La question de la protection des droits de l’homme dans les opérations de maintien de la paix est relativement récente. Elle se rattache en réalité, à la problématique générale de la protection des droits de l’homme à l’échelle internationale. En effet, la question des droits de l’homme reste au centre de toute réflexion sur la condition humaine et l’avenir du monde. C’est ainsi qu’au lendemain de la seconde guerre mondiale, on assiste à un sursaut de conscience planétaire devant les désastres des conflits. Aussi est-il important de relever que la communauté internationale des Etats dans son ensemble commence à discourir sur la condition humaine. Par ailleurs, si la fin de « la guerre froide » a permis, à certains égards de revenir à une mise en œuvre de la Charte plus proche du dessein original de ses rédacteurs, l’élément fondamental de cette évolution réside dans l’acceptation des droits de l’homme comme un des piliers de la sécurité collective, et puis l’intégration desdits droits comme composantes essentielles des opérations de maintien de la paix. La liaison établie par le Conseil de sécurité entre menace à la paix et violation des droits de l’homme a permis d’introduire la dimension humanitaire, pourtant déjà présente dans la Charte des Nations Unies, au cœur même du Chapitre VII de la Charte. Toute cette évolution a amplifié la prise en compte des droits de l’homme dans la mise en œuvre des mandats des opérations de maintien de la paix. Sans doute, la pratique n’est pas encore très cohérente, mais l’enseignement est révélateur.

Le CEDIN lance une nouvelle collection intitulée « L’ONU et les opérations de maintien de la paix », l’idée étant de consacrer un livre à chaque crise au cours de laquelle l’ONU est intervenue, par la mise sur pied d’une ou plusieurs opérations. En guise d’introduction aux différentes monographies sur les opérations de maintien de la paix, le présent ouvrage s’intéresse à la vision française des opérations de maintien de la paix, ainsi qu’à la participation française à celles-ci. Le rôle majeur que joue la France au sein des Nations Unies n’est plus à démontrer, tant par son statut de membre permanent du Conseil de sécurité, que du fait de l’importance qu’elle accorde à la défense des droits de l’homme et du droit humanitaire dans le monde. Une analyse des opérations de maintien de la paix qui se veut exhaustive ne pouvait se priver d’une étude détaillée de la « spécificité française ». La richesse du livre réside dans son approche multidimensionnelle, permettant de couvrir les diverses facettes et l’extraordinaire complexité des opérations de maintien de la paix. C’est pour répondre à cette complexité qu’il a été fait appel à trois auteurs de profils différents un chercheur en science politique, un professeur de droit, un général Ce livre permettra ainsi d’éclairer fort utilement les réflexions futures qui seront menées dans le cadre de cette nouvelle collection. Une version anglaise sera publiée prochainement par l’Université des Nations Unies, dans le cadre de laquelle ce projet a été entrepris.

Alors que le renseignement et l'ONU apparaissent encore comme un oxymore du fait d'une vieille méfiance remontant à la guerre froide et de tentatives clandestines d'instrumentalisation des Nations Unies par ses Etats membres, le renseignement d'intérêt militaire est désormais peu à peu devenu un facteur essentiel d'efficacité opérationnelle des déploiements des Casques bleus. L'analyse de plusieurs cas d'OMP depuis une vingtaine d'années démontre qu'elles sont considérées comme impliquant des missions de renseignement dont l'activité principale est la recherche de l'information par l'observation, en totale conformité avec les principes du maintien de la paix. La multiplication des OMP dans des contextes fortement dégradés et soumis à des menaces asymétriques, rend les OMP dépendantes du renseignement d'intérêt militaire qui est désormais un formidable multiplicateur d'effets et de forces. Ce phénomène induit aussi une augmentation exponentielle des informations recueillies ainsi que la nécessité de mieux les exploiter et les stocker, tant au niveau opératif que stratégique. L'émergence du concept de protection des civils, placé au cœur de chaque mandat d'OMP, rend la détention d'une capacité autonome de renseignement incontournable afin de permettre aux autorités de l'ONU de disposer de l'ensemble des informations pour décider d'agir en toute connaissance de cause. Certes la nature même du renseignement n'est pas compatible avec l'état de multilatéralité car il repose sur une relation de confiance approfondie entre les différents producteurs et consommateurs du renseignement. Acquérir une capacité autonome de recueil et d'analyse nécessite donc de développer un corpus doctrinal adapté aux Nations Unies et de formaliser les actions de renseignement afin de rassurer ses Etats membres.

This volume explores the implementation of key gender policies in international peace and security, following the adoption of UN Security Council resolution 1325 in October 2000, the first thematic resolution on Women, Peace and Security. How should we understand women’s participation in peace processes and in peace operations? And what forms of gendered security dynamics are present in armed conflict and international interventions? These questions represent central themes of protection and participation that the international community has to address in order to implement UNSCR 1325. Thus far, the implementation has often employed varying approaches related to gender mainstreaming, a third theme of the resolution. Yet, there is a dearth of systematic data which until recently has restricted the ability of researchers to evaluate the progress in implementation and impact of UNSCR 1325. By engaging with both empirics and critical theory, the authors of this edited volume make important contributions to the gender, peace and security agenda. They identify some of the problems of implementing UNSC 1325 and offer a sobering assessment of progress of implementation and insights into how to advance our understanding through systematic research. In the late 1990s, NATO led the Kosovo Force (KFOR), charged with stabilizing Kosovo and the former Yugoslav Republic of Macedonia after genocide and other atrocities were carried out in the Balkan region. Operation Kinetic is not only a history of the origins and operations of the Kosovo Force but also a history of the vital operations conducted by the Canadian Army units and their allies assigned to KFOR during the crucial early days and months after entry into the province in 1999 and through 2000.
