Lo studio ha ad oggetto i problemi connessi alla disciplina delle garanzie mobiliari nella prospettiva del commercio internazionale. Si tratta di un problema attuale e delicato, verso il quale gli operatori giuridici hanno rivolto l'attenzione in misura crescente negli ultimi anni, e ciò in ragione della continua mobiliarizzazione della ricchezza e della correlata esigenza di sicurezza nella circolazione dei beni. L'importanza e l'attualità del tema è testimoniata anche dai molteplici interventi legislativi (nazionali, comunitari e internazionali) volti a costruire un apposito quadro giuridico per le garanzie mobiliari (cfr. da ultimo il decr. lgs.vo 21 maggio 2004 n. 170 e la Convenzione dell'Aja del 5 luglio 2006). All'interesse della pratica verso il tema delle garanzie mobiliari si è poi associato quello degli studiosi. Nella dottrina italiana, peraltro, a differenza che all'estero, non è ancora apparso uno studio di carattere monografico che trattasse specificamente la soluzione dei conflitti di legge relativi alle garanzie. Lo studio muove proprio dalla constatazione della fondamentale importanza - riscontrata anche nella pratica professionale - della determinazione della legge applicabile alle garanzie mobiliari che assistono rapporti obbligatori.
