La seguridad pública como valor fundante de los cimientos del Estado de Derecho Democrático traduce dos atributos para su explicitación: su carácter ciudadano (convivencial) y su carácter jurídico (normativo); por ello los autores hablan traslativamente de seguridad ciudadana y seguridad jurídica. La seguridad pública es el ecuador democrático de dos plos de confrontaciones antijurídicas; el abuso del derecho y el abuso del poder. En su mérito la teoría jurídica desarrolla los límites y responsabilidades tipificadas ante el desorden individual y el desvío de la autoridad. La reforma operada en el Código penal de 1995 por LO 1/2015 Y LO 2/2015, así como la aprobación de una nueva Ley Orgánica de Seguridad Ciudadana (LO 4/2015) ha supuesto una involución en el entendimiento jurídico de las nociones de orden público, paz pública y seguridad ciudadana. Como advierte en el Prólogo el maestro VIVES ANTÓN, la protección de esos tres bienes jurídicos fundamentales para la convivencia debe realizarse dentro del mayor respeto al orden constitucional de las libertades. Sin embargo, da la impresión de que el legislador español hubiera conflgurado la protección penal y administrativa de espaldas a ese orden, es decir, no tomando la prioridad de la libertad como punto de partida. Ante ese estado de cosas, los autores enjuician de manera muy crítica las novedades legislativas y abogan decididamente por una interpretación de la ley favorable al ejercicio de los derechos fundamentales, pues sólo así puede evitarse que estas reformas del miedo disuadan a los ciudadanos de ejercer sus derechos de participación en la vida pública.

The Handbook of Latin American and Caribbean Intelligence Cultures explores the contemporary efforts of Latin American and Caribbean nations to develop an intelligence culture. Specifically, it analyzes these countries’ efforts to democratize their intelligence agencies (i.e. to develop intelligence services that are both transparent and effective) to convert the former military regimes’ repressive security apparatuses into democratic intelligence communities—a rather paradoxical task, considering that democracy calls for political neutrality, transparency, and accountability, while effective intelligence services must operate in secrecy. Indeed, even the most successful democracies face this conundrum of democracy and intelligence; Latin America and the Caribbean region is not alone in facing this challenge. The legacy of the repressive military regimes or brutal civil wars—which have inspired in the public a general disdain toward intelligence services due to the grave human rights abuses—coupled with politicians’ persistent lack of interest or expertise in intelligence matters complicate the region’s quest for a proper balance between the competing demands of democracy and intelligence. This volume details the attempts of the region’s countries to overcome these obstacles and pursue democratic intelligence institution building—transforming the legal basis for intelligence; establishing democratic control and oversight mechanisms; and fostering intelligence openness, transparency, and outreach.
