Unsafe abortion remains one of the most neglected sexual and reproductive health problems according to the World Health Organisation. In recent years it has been estimated that nearly 44 million abortions occur annually leading to around 47,000 deaths. At this rate a woman will die of an unsafe abortion every 11 minutes. Bringing together a wealth of information from around the world, this book argues that the time has come for a great change in legislation, advocating a shift towards the legalization of abortion to improve the health of women in poorer countries. With attention to circumstances in each of the major continental regions, an outline of the global situation is provided to reveal the major trends in the provision and procurement of abortion, as well their effects. Presenting data drawn from over a hundred countries covering over ninety per cent of the world’s population, based on published statistical information, changes to legal frameworks, court cases and the accounts of local commentators and activists, Unsafe Abortion and Women's Health will be of interest to scholars and students of the sociology of medicine, gender and reproductive health, social and health policy and feminist studies.

Most industrialized countries have increased access to abortion over the past 30 years. Economic theory predicts that abortion laws affect sexual behavior since they change the marginal cost of having risky sex. We use gonorrhea incidence as a metric of risky sexual behavior. Using a panel of 41 North American, European and Central Asian countries over the period 1980-2000, we estimate the impact of abortion law reform on risky sex. Compared to the most restrictive legislation that permits abortion only to save the pregnant woman's life or her physical health, more liberal abortion laws are associated with at least thirty additional gonorrhea cases per 100,000 individuals. The marginal effect of laws which make abortion available on request is larger than the effect of laws which allow abortion on socioeconomic and mental health grounds. Our results are robust against a set of alternative sample constructions and model specifications.

We exploit the drastic liberalization of abortion laws in Romania in 1989 to examine long-term unintended consequences of abortion law reforms for the educational performance of children. Using test scores from PISA surveys conducted among the 1990, 1993, and 1996 birth cohorts, we employ a before-after strategy and a differences-in-differences approach to identify the effect of abortion law liberalization on children's cognitive abilities. Children born under a liberal abortion policy score significantly higher on tests, with the effects being higher in reading and science scores. Children born after abortion law liberalization are also more likely to attend an academic high school compared to those born under the old abortion law. Boys and children born in rural areas are more likely to benefit from the liberalization of abortion law. These outcomes can mainly be explained by the fact that these children were more likely to have been planned and wanted at the time of conception.

First published in 1984, Abortion Freedom explains the main reasons for widespread international liberalisation of abortion laws. Colin Francome points out that the birth control movement had its roots in a concern with overpopulation and that this is still a crucial issue today. A major change, however, is that whereas in the early days the socialists were often opposed to birth control they are now amongst the keenest supporters of the woman’s right to choose. The author pays particular attention to the debates in the United States, France and Italy. It is aimed primarily at students of politics, sociology and law but it has a much wider appeal to the general public as a readable explanation of the ideas and strategies of the opposing forces involved.

It is increasingly implausible to speak of a purely domestic abortion law, as the legal debates around the world draw on precedents and influences of different national and regional contexts. While the United States and Western Europe may have been the vanguard of abortion law reform in the latter half of the twentieth century, Central and South America are proving to be laboratories of thought and innovation in the twenty-first century, as are particular countries in Africa and Asia. Abortion Law in Transnational Perspective offers a fresh look at significant transnational legal developments in recent years, examining key judicial decisions, constitutional texts, and regulatory reforms of abortion law in order to envision ways ahead. The chapters investigate issues of access, rights, and justice, as well as social constructions of women, sexuality, and pregnancy, through different legal procedures and regimes. They address the promises and risks of using legal procedure to achieve reproductive justice from different national, regional, and international vantage points; how public and courtroom debates are framed within medical, religious, and human rights arguments; the meaning of different narratives that recur in abortion litigation and language; and how respect for women and prenatal life is expressed in various legal regimes. By exploring how legal actors advocate, regulate, and adjudicate the issue of abortion, this timely volume seeks to build on existing developments to bring about change of a larger order. Locating the issue of abortion in a global public policy context, with the array of public health, human rights, and social questions that are implicated, is the aim of this paper. Abortion laws around the world have been liberalized since the 1950s, with a resultant decrease in abortion-related mortality among women. The proportion of the world's population, governed by laws that permit abortion on medical or broader social and economic grounds, is 75 percent (nearly 4 billion people). In addition to women living in those countries that have resisted liberalization of their abortion laws, many women have restricted access to abortion, even those in countries in which abortion is technically legal. There are a number of reasons for this, including a lack of government or public commitment to provide or fund services, lack of trained specialists, administrative roadblocks, a woman's ability to pay, and a lack of truthful information about legal rights and services. Abortion rates from countries around the world are examined and discussed in terms of the varying demographic and social realities. The large number of maternal deaths due to abortion that still occur is not due to a deficiency in technology, but a deficiency in the value placed on women's lives. The numerous roadblocks to safe abortion services drive women to seek illegal or clandestine abortions that greatly endanger their lives. The debate surrounding abortion has been too often portrayed as a conflict between black and white hues. The debate needs to take place in a larger context, complete with public health, family planning, and human rights concerns. Equality of political rights for women, and likely the lives of many, hinges on political decisions regarding abortion. (DB)
