Based on the policy-making structures of Venezuelan government, this book examines the constitutionally allocated powers of the executive and legislature and shows how the powers of each branch are exercised given the incentives established by the electoral system and changing partisan strengths. Several institutional characteristics have led to a passive legislature and an activist chief executive. The advantages presidents enjoy as a result of their constitutional and partisan powers are demonstrated by a wealth of empirical evidence, including records of votes of censure, initiation of legislation, and the use of decree authority. Because of its dominance, the Venezuelan executive branch is the focus of interest-group pressure, which is institutionalized through consultative commissions and a decentralized public administration. The author analyzes memberships of more than 300 advisory commissions and governing boards, revealing the preponderance of posts filled by umbrella agencies for business and labor. The interaction of this limited version of civil society with policy makers in the executive branch has led to a highly protectionist development strategy and excessive government subsidies. The strategy and the political process that made it possible were both exhausted by the end of the 1980s. Venezuela was in political and economic crisis. The author places Venezuela in a comparative context with other Latin American states on three issues: the likelihood that executives will receive disciplined, majority support in the legislature; the constitutional powers of presidents; and the degree to which business and labor are formally incorporated through single peak associations. Participation and policy-making processes vary significantly across Latin American democracies, with few others reaching the level of centralization that has characterized Venezuela. At the other end of the spectrum, some Latin American institutional designs are characterized by diffusion and fragmentation. In conclusion, the author offers a blueprint to modify some of the counterproductive patterns associated with Venezuela, one of the longest-lived but now troubled democracies in Latin America.

No puede negarse que el Derecho Administrativo ha construido buena parte de su teoría sobre conceptos inacabados e imprecisos, sobre los cuales no existe, en algunos casos, el más mínimo consenso. Ejemplo de ello son las nociones de servicio público, interés general, utilidad pública, contrato administrativo, acto de gobierno y acto administrativo. La idea de referirnos a ellos surge de la revisión de nuestra jurisprudencia, en especial la referida a la acción de nulidad. Al analizarla con la intención de precisar el alcance que se le da a la noción de actos administrativos como objeto de esa acción, encontramos una relativa utilización de la expresión “acto complejo”, aunque concediéndole en muchas ocasiones sentidos distintos. La constatación de la referida variación para definir una figura poco estudiada en Venezuela, pero que parecía tener utilidad práctica o al menos justificación teórica pues se acude a ella ocasionalmente, nos condujo a continuar la búsqueda de los fundamentos de la calificación de los actos administrativos complejos, por lo que recurrimos al resto de las fuentes de estudio de interés: la doctrina emanada de órganos administrativos, específicamente de los órganos consultivos de la Administración y de la Procuraduría y Contraloría General de la República, en la que también observamos muchas formas distintas de conceptualización. Inspirados, entonces, en la utilización jurisprudencial de la noción para explicar supuestos de muy variada clase y en los escasos estudios sobre el tema por parte de nuestros especialistas, realizamos una investigación sobre el particular, que resultó muy interesante, y presentamos este trabajo en el que exponemos sus resultados. Particularmente, resumiremos aquí el sentido que creemos que tiene el concepto de actos complejos y lo compararemos con el concedido entre nosotros. El presente trabajo lo hemos dividido en cinco partes. La primera la dedicamos al estudio de la noción de acto administrativo complejo. La segunda se destina a su distinción con las figuras que hemos mencionado en esta introducción: actos compuestos, actos colectivos, contratos entre entes estatales de carácter público, actos colegiales y procedimiento administrativo. Por último, desde la tercera hasta la quinta parte, revisaremos el tratamiento que ha tenido la expresión en la doctrina y jurisprudencia venezolanas (III y IV), así como en la doctrina emanada de los órganos consultivos de la Administración Pública y de la Procuraduría y Contraloría General de la República (V). "El Estado de derecho es, esencialmente, un Estado sometido a controles, primero, por parte de los ciudadanos mediante los mecanismos democráticos de participación política, comenzando por el ejercicio del sufragio; y segundo, por parte de los poderes constituidos en sus relaciones entre sí, que tienen que responder al principio de la separación de poderes, que es de su esencia. La Administración Pública, como instrumento del Estado para la gestión en nombre de la colectividad de los intereses generales, por tanto, es la primera que tiene que estar sujeta a controles tanto para asegurar el cumplimiento de los fines que tiene asignada, como el adecuado y eficiente manejo de los recursos públicos que se le asignan para ello. Para ello es que se han desarrollado importantes regulaciones legislativas sobre los mecanismos de control sobre la Administración Pública, los cuales incluso se han constitucionalizado, incluyéndose los destinados a asegurar la lucha contra la corrupción. Sin embargo, es evidente que no basta la consagración constitucional o legislativa de los mecanismos de control para asegurar su efectiva vigencia, siendo indispensable, para ello, como condición mínima, que el régimen político en el cual funcione el Estado y su Administración sea un régimen democrático, en el cual, entre sus elementos esenciales, esté garantizada la necesaria separación e independencia de los poderes públicos, cuya existencia es lo único que poder garantizar el control efectivo del ejercicio del poder por parte de los gobernantes".
